<br />80 <br /> <br />TUESDAY, MAY 13, 1986 <br /> <br />cases he must prosecute each year, he and his office are not equipped to provide the <br /> <br />assistance victims/witnesses require. As had already been pointed out, the cost of <br /> <br />such a program for the City of Martinsville during its first year would probably be <br /> <br />fully funded through the Commonwealth of Virginia; however, there is no assurance <br /> <br />thereafter and if the program continues under the sponsorship of the County of Henry <br /> <br />(and if the City agrees to participate), the cost to the City is estimated to be <br /> <br />$20,905.00 during the second year. After some discussion, and upon motion (duly <br /> <br />seconded and unanimously carried), Council agreed not to participate in the program <br /> <br />(apparently unless and until "outside" funding is assured for the second year and <br /> <br />thereafter). <br /> <br />City Manager Brown informed Council, by means of copies of documents recently relayed <br /> <br />to him by Mr. Jack F. Hankins, Attorney at Law and Special Defense Council to the <br /> <br />City in the litigation case of Lanier Farms, Inc., vs. Planning Commission of the <br /> <br />City of Martinsville, et al, that plaintiff has withdrawn its appeal (of a decision <br /> <br />favorable to the City by the Martinsville City Circuit Court) to the Supreme Court <br /> <br />of Virginia and, therefore, the case is considered closed. Mr. Hankins' fee for <br /> <br />legal services rendered (July 26, 1985 <br /> <br />April 29, 1986) was $1,100.00 plus $17.00 <br /> <br />for transcript of record, which costs Mr. Brown indicated he has placed in line for <br /> <br />payment. In connection with this suit instituted by Lanier Farms, Inc., seeking the <br /> <br />court's order that the Martinsville Planning Commission be directed to approve a <br /> <br />subdivision proposed by Lanier Farm as an extension of Lanier Road, Council was in- <br /> <br />formed that, upon recent presentation by Lanier Farm of a revised plat which pro- <br /> <br />jects an extension of Lanier Road, in stages, to connect with Meadowview Lane, the <br /> <br />Planning Commission has approved said revised plat and, therefore, Lanier Farm, Inc., <br /> <br />in association with a developer, or the developer, may now construct as many as <br /> <br />twelve living units on said extension, at a designated location, without being <br />
