Meanwhile, Council acknow- <br /> <br />ledged with appreciation the expression from the West Piedmont Planning District <br /> <br />Commission's Executive Director (Mr. Mark R. Henne), in his letter of April 28th <br /> <br />transmitting the foregoing to Mayor Cole, recognizing ".....the fine cooperation <br /> <br />that the City's representatives have given the Commission's staff in development and <br /> <br />processing....." said amendment and, also, the excellent cooperation between the City <br /> <br />of Martinsville and the County of Henry (and its PSA) in matters of mutual interest, <br /> <br />such as on-going efforts to meet the area's water and wastewater treatment needs. <br /> <br />By means of a copy of the following resolution unanimously adopted, Council will seek <br /> <br />the State Compensation Board's concurrence with the opinion of the Council that, as <br /> <br />permitted under Section 15.1-821 of the CODE OF VIRGINIA (1950, and as amended), par- <br /> <br />ticularly by the 1986 Session of the Virginia General Assembly), that the Common- <br /> <br />wealth's Attorney for the City of Martinsville, and his staff, shall devote full time <br /> <br />to the duties of that office and shall not engage in the private practice of law, <br /> <br />effective July 1, 1986 (with which resolution and opinion Commonwealth's Attorney J. <br /> <br />Randolph Smith, Jr., indicated agreement): <br /> <br />WHEREAS, Section 15.1-821 of the CODE OF VIRGINIA, as amended and <br />reenacted by the 1986 Session of the Virginia General Assembly, <br />effective July 1, 1986, provides that, in cities having a population <br />of more than 17,000 but less than 35,000, Commonwealth's attorneys <br />and all assistant attorneys for the Commonwealth shall devote full <br />time to their duties and shall not engage in the private practice of <br />law, if the respective governing bodies and the State Compensation <br />Board concur; and <br /> <br />WHEREAS, according to the official and last-revised 1980 census, the <br />population of the City of Martinsville is 18,149 and, therefore, is <br />within the parameters set forth herein above; and <br /> <br />WHEREAS, it is the opinion of the Council of the City of Martinsville, <br />Virginia, that the Commonwealth's Attorney of the City of Martins- <br />ville, and his staff, shall devote full time to the duties of that <br />office and shall not engage in the private practice of law; now <br />therefore, <br />
