<br />23~ <br /> <br />TUESDAY, APRIL 8, 1986 <br /> <br />After noting some public reaction registered with members of Council on a proposed <br /> <br />ordinance (placed on first reading by Council at its recent March 25th meeting) which <br /> <br />would amend Section 5-39 of the City Code, upon motion, duly seconded and unanimously <br /> <br />carried, Council adopted said amending ordinance, which carried the approval of the <br /> <br />City Manager, the City Attorney, the Commonwealth's Attorney, and the Police Chief. <br /> <br />The amending ordinance, identified as Ordinance No. 86-3, follows: <br /> <br />BE IT ORDAINED by the Council of the City of Martinsville, Virginia, <br />in regular session assembled this 8th day of April, 1986, that Chap- <br />ter 5 Animals and Fowl, Article III Dogs, Section 5-39 Continuously <br />barking or howling dogs, of the City Code be, and hereby is, amended, <br />as follows: <br /> <br />Sec. 5-39 Barking or howling dogs. <br /> <br />(a) It shall be unlawful for the owner or custodian of any <br />dog to allow such dog to frequently, for a period of three <br />minutes or longer, bark, howl, or create noise loud enough <br />to be heard outside the confines of the premises where such <br />dog is located. <br /> <br />(b) Upon conviction of the owner or custodian for a vio- <br />lation of this section, the court trying the case shall <br />order that the noise be abated or the offending dog be <br />permanently removed beyond the limits of the city. <br /> <br />Council unanimously accepted for introduction--and for further consideration and/or <br /> <br />action at its forthcoming April 22nd meeting--an ordinance (identified as Ordinance <br /> <br />No. 86-4) which, if adopted, will amend Section 12-140 of the City Code to bring same <br /> <br />into compliance with statutory revisions relating to motor vehicles and driving- <br /> <br />while-intoxicated enacted by the 1986 Session of the General Assembly. <br /> <br />Council continued for further consideration and/or action at its forthcoming April 22nd <br /> <br />meeting, pending a position response thereto from the City School Board, a resolution <br /> <br />which, if adopted, will express Council's concurrence with a proposal that a Regional <br /> <br />Commission for Educational Planning be organized for the purpose of promoting and <br />
