<br />32 <br /> <br />TUESDAY, MARCH 25, 1986 <br /> <br />conduct pony rides and hot-air balloon rides at petitioner's premises, beginning <br /> <br />April 12th, which activities City Attorney Worthy ruled would be outside the scope <br /> <br />of activities recommended by the Planning Commission and, therefore, inasmuch as <br /> <br />these two activities have not been discussed with the Commission nor considered by <br /> <br />the Commission, Piedmont Arts' petition should be returned to the Commission for <br /> <br />its consideration and recommendation. After some discussion, Council unanimously <br /> <br />agreed to amend the Special-Use Permit as recommended and to include the two "new" <br /> <br />uses, subject to review by the Commission as to the safety aspects thereof. <br /> <br />In response to Council's request (from its regular meeting held March 11, 1986), <br /> <br />City Attorney Worthy presented a revision of the ordinance proposed to Council at <br /> <br />said March 11th meeting and, in consultation with City Manager Brown, Police Chief <br /> <br />Terry L. Roop, and Commonwealth's Attorney J. Randolph Smith, Jr., a second revision <br /> <br />of said ordinance which, if adopted, would amend Section 5-39 of the City Code, <br /> <br />which Section 5-39 attempts to regulate barking and/or howling dogs. In tentative <br /> <br />acceptance of the second revision or amendment, Council placed same on first <br /> <br />reading for further consideration thereof and/or action thereon at Council's forth- <br /> <br />coming April 8th meeting. <br /> <br />Council unanimously adopted the following resolution which requests the Virginia <br /> <br />Department of Highways & Transportation to add as eligible mileage for street main- <br /> <br />tenance payments 0.2 lane miles of Lavinder Street and 0.1 lane miles of Salem Street: <br /> <br />WHEREAS, the City of Martinsville is entitled to receive assistance <br />payments for the maintenance of eligible streets under the State <br />Functional Classification System as set forth in Section 33.1-41.1 <br />of the State Code; and <br /> <br />WHEREAS, in accordance with Virginia Department of Highways and <br />Transportation procedures for adding urban streets eligible for <br />maintenance payments under the State Function Classification <br />System as set forth in Section 33.1-41.1 of the Code, it is <br />
