<br />TUESDAY, SEPTEMBER 8, 1987 <br /> <br />- <br /> <br />and by adopting the folowing ordinance directing the closing and vacating of said <br /> <br />alley: <br /> <br />BE IT ORDAINED by the Council of the City of Martinsville, Virginia, in <br />regular meeting assembled this eighth day of September, 1987, that a <br />ten-foot alley situated on the south side of Market Street between Lots <br />Nos. 24 and 25, west of Ellsworth Street, and extending for the distance <br />of said Lots Nos. 24 and 25, as shown on Section 33 (subsection P) of the <br />City's Tax Map, be--and is hereby--closed and abandoned. <br /> <br />BE IT FURTHER ORDAINED by said Council that, an emergency existing, this <br />ordinance shall be in force on and after September 9, 1987. <br /> <br />/~ <br /> <br />In acceptance of the Planning Commission's report and recommendation (dated August <br /> <br />21, 1987) as well as that of City lfunager Brown, Council unanimously authorized the <br /> <br />City Manager to execute--on behalf of the City--an agreement/contract with Mr. John <br /> <br />Wayne Johnston and Mrs. Marie H. Johnston, husband and wife, by which or under which <br /> <br />the City will provide City water service to the Johnstons' property located on the <br /> <br />west side of Route 57-A (Chatham Heights area), outside of the City's corporate <br /> <br />limits but within the City's service area as established in the 1982 City/County <br /> <br />(PSA) Water Agreement. In accordance with the Planning Commission's recommendation <br /> <br />and inasmuch as this property is being developed as an automobile service station, <br /> <br />Council directed that the agreement/contract contain and specify convenants <br /> <br />applicable to usage allowed within the City's C-3 Commercial-zoned areas. <br /> <br />-- <br /> <br />Upon recommendation of City Manager Brown, Council accepted for introduction and <br /> <br />first reading a proposed ordinance (identified as Ordinance No. 87-7) which, if <br /> <br />adopted (as scheduled for Council's forthcoming September 22nd meeting), will amend <br /> <br />Section 4.1-b (Deposits) of the City's Terms and Conditions of Electric Service <br /> <br />with the intent of achieving greater equity in the aomunts of electric service <br /> <br />deposits required for the City's professional/commercial/industrial customers. <br />
