<br />:>0 <br />')0 <br /> <br />TUESDAY, AUGUST 25, 1987 <br /> <br />highways in general, with the result that the new policy will have little effect <br /> <br />on street-highway projects in Martinsville because the City is already committed <br /> <br />to a number of projects which are to be administered by the Department of <br /> <br />Transportation. Even so, Mr. Brown pointed out, irrespective of administration, <br /> <br />construction of street and/or highway projects is limited or regulated by State <br /> <br />funding and allocations. Meanwhile, Councilman McClain raised questions as to--if <br /> <br />the City administers a project or projects--who would conduct any required <br /> <br />environmental studies, who would be responsible for right-of-way acquisitions and <br /> <br />relocations of citizens, what might be the impact upon City personnel involved, <br /> <br />and would the City be able to administer a project or projects; whereas, Councilman <br /> <br />Cole inquired as to the status (under the new policy) of the Commonwealth <br /> <br />Boulevard extension project. <br /> <br />In response to Councilman Cole's recent request, City Manager Brown presented a <br /> <br />report (prepared by Mr. Leon E. Towarnicki, the City's Public Works Director) <br /> <br />describing--in the absence of a written policy--general procedures followed by the <br /> <br />City and its Prison Farm in the selling of surplus produce grown at the Prison <br /> <br />Farm. Councilman Cole, after inquiring as to whether these procedures apply to <br /> <br />excess firewood, urged that, if there are surplus produce and surplus firewood, <br /> <br />everyone be given an equal opportunity to purchase such surplus products, unless <br /> <br />such surpluses can be donated to charitable institutions in accordance with an <br /> <br />adopted policy. <br /> <br />City Manager Brown informed Council that, in an opinion by Virginia's Attorney <br /> <br />General Mary Sue Terry submitted to the City's Commissioner of the Revenue <br /> <br />(J. Ronnie Minter), the Commissioner of the Revenue may continue to assess leased <br /> <br />computer equipment as tangible personal property, once an appeal now before the <br /> <br />Virginia Supreme Court has been perfected, "....since execution of the judgment <br /> <br />of the circuit court will then be suspended by operation of law." <br />
