<br />:'0 <br /> <br />TUESDAY, JULY 28, 1987 <br /> <br />(1) a new contract with APCo; (2) APCo's contract with Southeastern Power <br />Association (SEPA); (3) the SEPA billing credit from APCo to the City; and <br />(4) the new wholesale tariffs; and <br /> <br />WHEREAS, these negotiations have been consummated with proper contracts <br />having been executed by the respective agencies involved; now, therefore, <br /> <br />BE IT RESOLVED by the Council of the City of Martinsville, Virginia, in <br />regular session assembled July 28, 1987, that said Council accepts this <br />Agreement as submitted; and <br /> <br />BE IT FURTHER RESOLVED that said Council hereby authorizes the City's legal <br />counsel, Frederick H. Ritts of Ritts, Brickfield & Kaufman, Washington, D. <br />C., to sign the Settlement Agreement in the case captioned Appalachian <br />Powe~ Company, Docket No. ER87-106-001 before the Federal Energy Regulatory <br />Commission. <br /> <br />Council unanimously approved for Mayor Oakes' signature and execution on behalf of <br /> <br />the City a lease agreement between the City and Mr. & Mrs. Ralph C. Lester (viz., <br /> <br />Ralph C. Lester and June D. W. Lester), by which agreement the City will lease to <br /> <br />Mr. & Mrs. Lester for an indefinite term, with right of cancellation by City (under <br /> <br />certain conditions), a fifteen-foot strip of "residual" land (from the Memorial <br /> <br />Boulevard construction of some years ago) situated along the north side of Memorial <br /> <br />Boulevard, between Broad and Bridge Streets, and abutting property owned and being <br /> <br />developed by Mr. & Mrs. Lester. <br /> <br />Council continued to its forthcoming August 11th meeting, at which Vice-Mayor <br /> <br />Williams can be present, a Personnel Office Report for the year ended June 30, 1987, <br /> <br />as prepared by Mr. J. Michael Grubbs, who recently resigned as Assistant to the City <br /> <br />Manager. <br /> <br />Pursuant to Council's request from its July 14th meeting, City Manager Brown <br /> <br />presented an itemized estimate (as prepared by Mr. Leon E. Towarnicki, the City's <br /> <br />Public Works Director) of the cost of including curb-and-gutter, with grading and <br /> <br />seeding, plus plant-mix type surface, in a project (suggested by Councilman McClain) <br /> <br />by which a connector street between Childress Drive and Smith Lake Road would be <br /> <br />constructed.
