<br />,) <br />I~ <br /> <br />TUESDAY, JUNE 23, 1987 <br /> <br />Council unanimously adopted the following ordinance (identified as Ordinance No. <br /> <br />87-4, introduced at Council's June 9th meeting), which amends Section 12-140 of the <br /> <br />City's Code of Ordinances to parallel, or be consistent with, State motor vehicle <br /> <br />and/or driving-while-intoxicated statutes, as updated and amended by the 1987 <br /> <br />session of the Virginia General Assembly: <br /> <br />AN ORDINANCE OF THE CITY OF MARTINSVILLE, VIRGINIA, PROVIDING THAT THE CODE <br />OF ORDINANCES, CITY OF MARTINSVILLE, BE AMENDED AS TO ARTICLE VI, SECTION <br />12-140; PROVIDING FOR ADOPTION OF CERTAIN AMENDMENTS AND ADDITIONS TO STATE <br />LAW. <br /> <br />BE IT ORDAINED by the Council of the City of Martinsvi11e, Virginia, in <br />regular session assembled, that the Code of Ordinances of the City of <br />Martinsville be amended so as Section 12-140 shall read as follows: <br /> <br />Section 12-140. Adoption of amendments and additions to motor <br />vehicle laws by reference. <br /> <br />The term "laws of the state relative to the operation of <br />vehicles" used in Section 12.2, and the term "laws of the state <br />relative to driving a motor vehicle, etc., while intoxicated," <br />used in Section 12-3, shall be defined and interpreted to include <br />all such laws in effect on July 1, 1987. <br /> <br />Council carried forward to its forthcoming July 14th regular meeting, for further <br /> <br />consideration and/or action, proposed amendments to--and changes in--the City's <br /> <br />Employee Manual, some of which amendments or changes will update the Manual to <br /> <br />reflect updated Federal and State legislation; meanwhile, Council unanimously <br /> <br />adopted the following resolution which amends Section 8-3.2 of the City's employee <br /> <br />grievance regulations (set forth in the Employee Manual) to comply with State- <br /> <br />mandated requirements: <br /> <br />WHEREAS, the General Assembly of Virginia has amended Section 2.1-114.51 of <br />the Code of Virginia relating to the grievance procedure for state and <br />local government employees; and <br /> <br />WHEREAS, the Senate Bill 529 mandated changes that must be incorporated <br />into local government grievance procedures by July 1, 1987; and <br /> <br />WHEREAS, the Virginia Department of Employee Relations Counselors has <br />requested that each locality submit for approval a resolution amending its <br />procedure, including the exact language of Senate Bill 529 and identifying <br />the section of the local government procedure to be amended; now, <br />therefore, <br />
