<br />TUESDAY, JUNE 23, 1987 <br />I <br /> <br />- <br /> <br />BE IT RESOLVED by the City Council (the "Council") of the City of Martins- <br />vi11e, Virginia, in regular session assembled June 23, 1987, that: <br /> <br />1. The Council hereby amends the Grievance Procedure, Section <br />8-3.2(f), Non-Grievab1e Issues, to state that "discharge, <br />demotion, transfer, reclassification, suspension or layoff <br />because of lack of work, reduction in work force or job <br />abolition" are not grievable issues "except where such action <br />affects an employee who has been reinstated within the <br />previous six months as the result of the final determination <br />of a grievance". <br /> <br />~ <br /> <br />2. The following sentence shall be added to the end of Section <br />8-3.2: "In any grievance brought under the exception to (f), <br />the action shall be upheld upon a showing by the City that <br />there was a valid business reason for the action, and the <br />employee was notified of such reason in writing prior to the <br />effective date of the action." <br /> <br />The undersigned Clerk of the Council of the City of Martinsville, Virginia, <br />hereby certifies that the foregoing is a true, correct and complete copy of <br />a resolution duly adopted by the City Council on June 23, 1987. <br /> <br />City Manager Brown reported (by memorandum dated June 17, 1987) that, after many <br /> <br />months of negotiations between the "APCo" cities in Virginia and the Appalachian <br /> <br />Attorneys at Law, Washington, D.C.), a new wholesale electric energy purchase <br /> <br />Power Company, under the guidance of legal advisors (Ritts, Brickfield & Kaufman, <br /> <br />contract has been developed for the City of Martinsville with Appalachian Power <br /> <br />Company, proposed to become effective July 1, 1987, and to continue in force for ten <br /> <br />years, with successive one-year renewal options and with certain cancellation <br /> <br />~ <br /> <br />options.
