<br />i42 <br /> <br />TUESDAY, JANUARY 13, 1987 <br /> <br />Upon motion, duly seconded and unanimously recorded, Council approved--as recorded-- <br /> <br />the minutes of Council's regular meeting held December 9, 1986. <br /> <br />Council unanimously called for a public hearing to be conducted by Council at its <br /> <br />forthcoming January 27th regular meeting on the Planning Commission's recommendation <br /> <br />that the specified areas along Market Street be rezoned to C-IA Commercial, viz., <br /> <br />(1) the areas north of Market Street, between Ellsworth Street and West Church <br /> <br />Street; presently zoned R-P Residential-Professional, and (2) the areas south of <br /> <br />Market Street, adjoining College Street south to Railroad Street and now zoned R-6 <br /> <br />Res iden tial. <br /> <br />Upon motion, duly seconded and unanimously carried, Council adopted the following <br /> <br />ordinance (identified as Ordinance No. 87-1), as introduced and revised at Council's <br /> <br />recent December 9th meeting, which ordinance amends Section 13-37 of the City Code <br /> <br />and revises prior requirements and/or controls pertaining to grass and weeds and <br /> <br />like vegetative growth on properties within the City: <br /> <br />BE IT ORDAINED by the Council of the City of Martinsvi1le, Virginia, in <br />regular session held January 13, 1987, that Chapter 13 Offenses-- <br />Miscellaneous, Section 13-37, Excessive Growth of Grass, Weeds, Etc., on <br />Vacant Property, Sub-section (a), be and is hereby amended, as follows: <br /> <br />Sec. 13-37. Excessive growth of grass, weeds, etc., on vacant <br />property. <br /> <br />(a) It shall be the duty of the owner of any parcel of land in <br />the city to cut or cause to be cut all grass, weeds or like vege- <br />tative growth which exceeds a height of eighteen (18) inches above <br />the ground and which is deemed by the director of public works to <br />create a potential threat to public health or safety; and it shall <br />be the duty of the owner of any legally established lot situated <br />in the city fronting a city-maintained public street to cut there- <br />on any weeds, brush, grass or like vegetative growth if an occu- <br />pied building or residence is situated on an adjacent lot, subject <br />to the following: Applicable growth shall be cut to a height of <br />eighteen (18) inches above ground for a depth of eighty (80) feet <br />from the street line measured at ninety (90) degrees with the <br />street line, and such vegetative growth shall be cut two times per <br />year--between May 15 and June 15; and between August 1 and <br />September 1.
