January 27,2004 BE I'r~ORDAIN~D by the Council of the City of Martinsville, Virginia, in regular session hold on J~hu~ry 13, 2004, tl~at Sections 21-8.1 ahd 21-8.2 be added to ChaP(er 21 of the MartinSville Code to read as follows: Sec. 21-8.1. Personal property tax gbhbrally. Except as proviSed in sectioh~ 21-8 and 21-8.2, there is hereby imposed and levied a ~brsbnal property tax on the assessed value of all tangible personal property and machinery and tools as classified in Code of Virgihia, § 58.1-3500 et seq., with a situs in the City as of January 1 of each year at a rate or rates established annually by the city council. Sec. 21-8.2. Exemptions. All items of household goods and personal effects set forth in §58.1-3504, Cede of Virginia, are ekempt frOm persOnal property taxation. Council considered a~o~fion, on second reading of Ordinance 2004-3 adding Section 21-84.1 to Chapter 21 Taxation of the City Code. Vice Mayor Roop moved to adopt, on second reading, of the following Orditiance 2004-3; the motion was duly seconded and Carried by the f01ibwing roll call vote, with all members voting: 0; Yeas (5) - Cobbe, Dallas, Fe~riil, Roop, Teague; Nays (0) - Nohe: Vote 5 - BE IT ORbAiN~b by tt~e council of the City of Martinsville, Virginia, in regular session held bh January 13, 2004, that paragraPh (d) be added to Section 21-85 of Chapter 21 of the Martinsville Code tO re~d as follows: Sec. 21-85. Penalty for violation of a, rticle. (d) All amounts collected as taxes under this article shall be deemed to be held in truest by the seller collecting ti-ibm until remit[Od to the City. THe wrongful and fraudulent use of such collection other than i'emittafiSb Of the same shall, in addition to the Other ~halties i~'l~(~§ed in this Article, constitute embezzlement pursuant to the Code of Virginia §18.2-111.
