April 22, 2003 <br /> <br />WHEREAS, fiscal constraints, both current and projected, facing <br />the City of Martinsville dictate a more cautious policy concerning <br />the consideration of tax-exempt requests by not-for-profit <br />organizations, and <br />WHEREAS, a Constitutional amendment referendum and <br />subsequent enacting legislation has fundamentally changed the <br />process for seeking tax exemptions, and <br />WHEREAS, the City Council finds it appropriate to place a <br />moratorium on the consideration of such tax-exempt requests until <br />the city's financial position is clarified; now, therefore <br />BE IT RESOLVED that: <br />1. It is the policy of the City of Martinsville that requests for tax <br /> exemption are not generally endorsed or encouraged; <br />2. A moratorium on the consideration of tax exempt requests <br /> by not-for-profit organizations will be in effect immediately <br /> and continue in effect until further notice; <br />3. Organizations currently enjoying tax exempt status in the <br /> City of Martinsville will maintain such status; <br />4. Organizations who enjoy tax-exempt status by virtue of <br /> statutory classification (i.e., churches) are unaffected by this <br /> moratorium. <br /> <br />Council considered adoption, on first reading, of Ordinance 2003-4 amending <br /> <br />Ordinance 2000-4 relating to the meals tax notification process used by the <br /> <br />Commissioner of the Revenue to collect such taxes. Ruth Krauss, Commissioner of the <br /> <br />Revenue, highlighted the rationale. Vice Mayor Roop moved to adopt, on first reading, <br /> <br />Ordinance 2003-4; the motion was duly seconded and carried by the following roll call <br /> <br />vote, with all members voting: Vote 5 - 0; Yeas (5) - Cobbe, Dallas, Ferrill, Roop, <br /> <br />Teague; Nays (0) - None. <br /> <br />Council considered a Public Hearing and adoption, on first reading, of Ordinance <br /> <br />2003-3 on a request by the Planning Commission to amend Zoning Ordinance Sections <br /> <br />I-VIE and XVI-XXIV. George Hayfield, Associate Planner, reviewed the revisions. <br /> <br />Mayor Teague declared the Public Hearing open. John Sanders, of 308 Starling <br /> <br />Avenue, spoke in opposition.
