Enclosure #2 <br /> <br />September 21, 2001 <br /> <br />Martinsville <br />A CITY WITHOUT LIM TS <br /> <br />The Honorable Mayor and City Council <br />City of Martinsville <br />Martinsville, Virginia <br /> <br />Dear Council Members: <br /> <br />The Planning Commission, at its regular meeting on September 20, 2001, conducted a duly <br />advertised Public Hearing on a request by the American Properties Management Corporation and <br />formerly known as King's Mountain Development Corporation and The Lester Group, to <br />abandon the undeveloped portion of a public right of way known as Perdtie Street and consisting <br />of a road space 30 x 890 feet, as shown on Tax Map 1 l(1)9A, 9B, 9C. <br /> <br />At the Public Hearing it was noted the properties adjacent to this proposed abandonment are <br />owned by the petitioner. The road space petitioned for abandonment extends across three parcels <br />which must be consolidated to meet the requirements of the Zoning Ordinance and facilitate <br />development of the CINCAP Martinsville, LLC (Cinergy) project to be built on this site. In <br />order to assure compliance with Virginia Code § 15.2-2200, it is stated that the public purpose for <br />which these Resolutions are initiated is to fulfill the requirements of public necessity, <br />convenience, and general welfare. <br /> <br />Following discussion of the matter, the Planning Commission voted unanimously (6-0) to <br />recommend to City Council that the proposed abandonment be granted. <br /> <br />The Planning Commission respectfully submits the above recommendation for Council's further <br />consideration. <br /> <br />Sincerely, <br /> <br />Jean P.
