AN ORDINANCE <br /> <br />ABANDONING STREET SPACE <br />CITY OF MARTINSVILLE <br /> <br /> WHEREAS, American Properties Management Corporation and formerly known as <br />King's Mountain Development Corporation and The Lester Group, applied, pursuant to the <br />provisions § 15.2-2006 of the Code of Virginia, to have vacated the undeveloped portion a public <br />right-of-way consisting of a road space 30 feet wide and approximately 890 feet long known as <br />Perdue Street, as shown on City Tax Map 11(1), and, <br /> <br /> WHEREAS, notice of intention to vacate this portion of Perdue Street has been published <br />at least twice, with at least six days elapsing between the first and second publication, in a <br />newspaper having general circulation in this locality, specifying the time and place of the hearing <br />at which persons affected may appear and be heard, which hearing was held on October 23, 2001 <br />by Martinsville City Council, and, <br /> <br /> NOW THEREFORE, BE IT ORDAINED by the Council of the City of Martinsville, <br />Virginia, in regular sesSion held on October 23, 2001, that the undeveloped portion of Perdue <br />Street be, and it hereby is, vacated pursuant to the provisions of § 15.2-2006 of the Code, as <br />aforesaid, said vacation to take effect upon the payment of $1,602.00, by American Properties <br />Management Corporation and The Lester Group, to the City of Martinsville to purchase from <br />said City the right-of-way herein vacated, title to which thereby vested in American Properties <br />Management Corporation, and the filing of an appropriate map with - and the approval by - the <br />City's Planning, Zoning and Housing Manager, showing the areas hereby declared vacated and <br />abandoned, which map, when and as approved, shall be duly recorded in the Office of the Clerk <br />of Martinsville City Circuit Court, and, <br /> <br /> BE IT FURTHER ORDAINED that a certified copy of this ordinance to vacate shall be <br />recorded as deeds are recorded and indexed in the name of the City of Martinsville in the Clerk's <br />Office of the Circuit Court of the City of Martinsville, Virginia, and <br /> <br /> BE IT FURTHER ORDAINED by said Council that, an emergency existing, this <br />ordinance shall be in force immediately upon adoption. <br /> <br />Johnathan Phillips, Clerk of Council <br /> <br />Date Adopted <br /> <br />Date Effective <br /> <br /> <br />
