July 10, 2001 <br /> <br />motion was duly seconded and carried by the following roll call vote, with all members <br /> <br />voting: Vote 5 - 0; Yeas (5) - Crabtree, Dallas, Ferrill, Roop, Teague; Nays (0) - None: <br /> <br />WHEREAS, the Virginia Board of Housing and Community <br />Development by its order entered on May 22, 2000, adopted the <br />present edition of the Virginia Uniform Statewide Building Code, <br />which became effective on September 16, 2000, and, <br />WHEREAS, Part III thereafter sets forth the scope, administration, <br />and enforcement procedures for the local option enforcement of the <br />maintenance provisions of the USBC, and, <br />WHEREAS, it is the desire of the Martinsville City Council to <br />enforce the property maintenance provisions on the USBC in their <br />entirety, and to assign responsibility for the enforcement of same to <br />its Inspection Division as the local enforcing agency and the <br />building official as the building maintenance code official. <br />NOW THEREFORE, BE IT ORDAINED by the Council of the City <br />of Martinsville, Virginia in regular session held on July 10, 2001 that <br />the Inspections Division be, and it hereby is, designated to act as <br />the enforcing agency for the enforcement of the maintenance <br />provisions of the Virginia Uniform Statewide Building Code (USBC) <br />and the therein referenced BOCA National Property Maintenance <br />Code (BNPMC) as duly amended and adopted by the Virginia <br />Board of Housing and Community Development under authority of <br />Section 36-98, Code of Virginia. Enforcement shall be according to <br />the USBC and the term of this ordinance. <br />BE IT FURTHER ORDAINED that the enforcement procedure shall <br />be instituted and administered by the building maintenance code <br />official in accordance with the provisions of the USBC and that said <br />building maintenance code official shall establish such procedures <br />or requirements as may be necessary, but not in conflict with the <br />USBC, for administration and enforcement of this ordinance. The <br />procedures are to be approved by this Council. <br />BE IT FURTHER ORDAINED that the local board of building code <br />appeals is hereby designated to hear appeals arising from the <br />application of the maintenance provisions of the USBC. <br />BE IT FURTHER ORDAINED that should any provision of this <br />ordinance be declared by the Courts to be unconstitutional or <br />invalid, such decision nctl; e,f[ecI t.h,~ yalidity of the ordinance as a <br />whole or ally 'parC there o[othel(th~[i the part so declared to be <br />unconstitution'~l or,1oyeli~..
