77 <br />May 22, 2001 <br /> <br />all members voting: Vote 5 - 0; Yeas (5) - Crabtree, Dallas, Ferrill, Roop, Teague; <br /> <br />Nays (0) - None: <br /> <br />BE IT ORDAINED by the Council of the City of Martinsville, <br />Virginia, in regular session assembled on May 22, 2001, that it <br />does hereby amend Chapter 13--Offenses-Miscellaneous, Article <br />I--In General, Section 13-43--Place Used for Illegal Drugs a <br />Nuisance; Presence at such Nuisance of the City' Code, as follows: <br />Section 13-43. Place used for illegal drugs a nuisance; knowingly <br />permitting, establishing, keeping or maintaining such is a Class 1 <br />misdemeanor. <br /> Any office, store, shop, restaurant, dance hall, theater, <br />poolroom, clubhouse, storehouse, warehouse, dwelling house, <br />apartment, building of any kind, vehicle, vessel, boat, or aircraft, in <br />this city, which with the knowledge of the owner, lessor, agent of <br />any such lessor, manager, chief executive officer, operator or <br />tenant thereof is frequented by persons under the influence of <br />illegally obtained controlled substances or marijuana, or is used for <br />the illegal possession of, manufacturing, or distributing controlled <br />substances or marijuana, shall be deemed a common nuisance. <br />Any such owner, lessor, agent of any such lessor, manager, chief <br />executive officer, operator or tenant who knowingly permits, <br />establishes, keeps or maintains such a common nuisance is guilty <br />of a Class 1 misdemeanor. <br />BE IT FURTHER ORDAINED that an emergency exists and that <br />this Ordinance shall be effective on and after this date. <br /> <br />Wade Bartlett, Director of Finance, presented the financial report for month <br /> <br />ending April 30, 2001. <br /> <br />Vice Mayor Teague moved to adopt the following Consent Agenda items; the <br /> <br />motion was duly seconded and carried by the following vote, with all members voting: <br /> <br />Vote 5 - 0; Yeas (5) - Crabtree, Dallas, Ferrill, Roop, Teague; Nays (0) - None: <br /> <br />A. Accept and appropriate $113.10 from Commonwealth of Virginia <br /> into Revenue 01101917-442401 - State Forfeited Assets for <br /> Expenditure 01311085-506078- State Forfeited Assets in the <br /> Police Department's budget in the General Fund for FY2000- <br /> 2001. <br />B. Set a Public Hearing for June 12, 2001, to receive applicants for <br /> one three-year appointment beginning July 1,2001, to the City's <br /> School Board. <br /> <br /> <br />
