<br />7 <br /> <br />TUESDAY <br /> <br />SEPTEMBER 8, 1959 <br /> <br />The regular semi-monthJy rooeting of the Council of the City of Martinsville, <br /> <br />Virginia, with Mayor John W. Shultz presiding, was held in the Council Chamber, <br /> <br />City Hall, Tuesday, September 8, 1959, at 6:30 P.M., all members of Council <br /> <br />being present, viz., Mayor and Councilman John 1;1[. Shultz; Vice-Mayor and <br /> <br />Councilman E. E. Stone; and Councilmen Thomas J. Burch, Clarence C. Donavant, <br /> <br />and J. Frank Wilson. <br /> <br />~- <br /> <br />After the invocation, Council approved as read the minutes of its regular <br /> <br />meeting held August 25, 1959. <br /> <br />After considering a recent petition requesting the establishing of a ten-foot <br /> <br />set-back on the east side of Cleveland Avenue between Church and Brown Streets <br /> <br />and, also, the Planning Commission's report and recOIllIOOmation thereon, as follows-- <br /> <br />in which the Commission recommended that the petition be denied-Council accepted <br /> <br />the C onnnission' s recommerrlation and, acc ordingly denied s aid petition: <br /> <br />Gentlemen: <br /> <br />The Planning Commission at its meeting September 1, 1959 considered a <br />petition referred to it by Council, with regard to the establishment of <br />a 10 ft. setback along the east side of Cleveland Avenue. The petition <br />was :31.IDmi tted by Mrs. J. V[. Simmons and others. <br /> <br />The Cormnission after due consideration of this petition and facts <br />presented by the petitioners voted unanimously to recommend to Council <br />f1that the petition be denied". <br /> <br />In arriving at this decision the following facts were considered: <br />1. The p3titioner's properties are presently zoned A-I residential, <br />which zone covers most of the eastern half of the City. <br />2. The present zoning ordinance requires a 25 ft. front setback in <br />the A-I residential district, which is uniform for the entire <br />dis tric t. <br />3. Under the present ordinance the erection of one building does not <br />establish a buildinG line. <br /> <br />It is the feeling of the Commission that conditions at this time in the <br />Cleveland Avenue area do not warrant the consideration of a change in the <br />setback for the A-I residential district, or, for the Cleveland Avenue <br />area. <br /> <br />The Planning Commission respectfully submits the above recommendation <br />for Council's further corsideration. <br /> <br />-~._.-."~-_._._---~ <br />
