<br />') {.~ <br />.....in ~ <br /> <br />TUESDAY <br /> <br />FEBRUARY 27, 1968 <br /> <br />The regular semi-monthly meeting of the Council of the City of Martinsville, <br /> <br />Virginia, with Mayor F. T. Renick, M.D., presiding, was held Tuesday, February <br /> <br />27, 1968, in the Council Chamber, City Hall, beginning at 7:30 P.M., all <br /> <br />members being present, viz., F. T. Renick, M.D., Mayor; E. E. Stone, Vice-Mayor; <br /> <br />Harry L. Boaz; W. Donald Hartford; and Francis T. West. <br /> <br />After the invocation, Council approved as recorded the minutes of its regular <br /> <br />meeting held February 13, 1968. <br /> <br />In resuming its consideration--from meeting of February 13th--of the protest <br /> <br />filed by the Retail Merchants Association against the ordinance adopted <br /> <br />December 26, 1967 (effective January 1, 1968), imposing an assessment of one <br /> <br />dollar ($1.00) on local civil actions filed to finance the cost of establishing <br /> <br />a law library for the local judiciary, Council heard from representatives of the <br /> <br />Merchants Association, including Mr. Raymond D. Ferrell, President, who expressed <br /> <br />support of the idea of establishing a law library but repeated opposition to the <br /> <br />method of financing the cost thereof as set forth in the civil action assessment <br /> <br />ordinance. Mr. Stafford G. Whittle, III, also a member of the Association, <br /> <br />however, recommended that the ordinance not be rescinded until a thorough study <br /> <br />.,- <br /> <br />be conducted as to how otherwise such a library can be financed. City Attorney <br /> <br />Irvin W. Cubine, in the role of Attorney at Law and private citizen, reported <br /> <br />that the local Bar Association, which initiated the idea--and set forth the need-- <br /> <br />of a law library, has stated "its case" and would not appear before Council again <br /> <br />on this matter. Mr. Cubine, in citing the need for such a library, also cited <br /> <br />his opinions supporting the method (as provided in the ordinance) of financing <br /> <br />- <br /> <br />the cost of the library and, furthermore, requested that the ordinance not be <br /> <br />rescinded. Members of Council were unanimous in their support of the establishing <br /> <br />of a law library but expressed "mixedll feelings as to the method of financing <br />
