<br />APPENDIX A-SUBDIVISION ORDINANCE <br /> <br />6-4 <br /> <br />6-2. Procedure for conditional approval of preliminary plat. <br /> <br />A. On completing action as provided in section 6-1 above, the subdivider shall cause to be <br />prepared a preliminary plat, together with improvement plans, and other required or desirable <br />supplementary material. <br /> <br />B. Five (5) copies of the preliminary plat and supplementary material specified shall be <br />submitted to the agent, with written application for conditional approval, and an appropriate <br />fee to be applied to the recordation fee or refunded if the plat is not finally approved. <br /> <br />C. If all or any part of a land area proposed for subdivision is situated in a flood hazard <br />area, concurrent with submission of the materials as set forth in subsection B above, an <br />additional copy of the preliminary plat and supplementary material shall be submitted to the <br />agent who shall submit same to the board of adjustment and appeals as referred to in the city's <br />flood plain ordinance through the building official. Said board shall review such plans and <br />supplementary material and submit a report to the agent within three (3) weeks after receipt <br />of such plans indicating whether, in its opinion, the proposed subdivision and development can <br />be accomplished in accordance with the requirements of the flood plain ordinance. <br /> <br />6-3. Compliance. <br /> <br />A. Review of the preliminary plat and other material submitted for conformity thereof to <br />these regulations; and <br /> <br />B. Receipt of a report from the board as specified in subsection 6-2-C above, if applicable; <br />and <br /> <br />C. Conferences with the subdivider when necessary on changes required for conformity <br />with these regulations or to consider variances from these regulations. <br /> <br />6-4. Notification. <br /> <br />A. The agent shall, within sixty (60) days from the date of the original submission of the <br />preliminary subdivision plat, act thereon as submitted, or modified, and, if approved, the agent <br />shall notify the applicant of the approval as a conditional approval and state the conditions, if <br />any, of such approval. If the agent does not approve the preliminary plat, he shall set forth in <br />writing the reasons for such denial and state what corrections or modifications will permit <br />approval by the agent, and, if such approval shall require variations in or exceptions to the <br />general regulations of this ordinance, the agent shall notify the applicant of any such <br />variations or exceptions that are needed to permit approval of the preliminary plat, and, upon <br />the request in writing of the applicant for the granting of said variations and exceptions, the <br />agent shall refer said request to the planning commission who shall make a recommendation <br />to the city council on the request for said variations or exceptions. City council shall then <br />grant, or refuse to grant, the requested variations or exceptions after receipt of the recom- <br />mendation of the planning commission. Final decision on a request for variations or exceptions <br />must be made within sixty (60) days from the date of the receipt of the written request for <br />variations or exceptions. <br /> <br />Supp. No. 61 <br /> <br />1743 <br />
