<br />5-36 <br /> <br />MARTINSVILLE CODE <br /> <br />5-36. Double frontage lots. <br /> <br />Double frontage lots should be avoided except where essential to provide separation of <br />residential development from traffic arteries or to overcome specific disadvantages of topog- <br />raphy and orientation. <br /> <br />5-37. Reservation of land for public purposes. <br /> <br />The administrator may require subdividers of residential subdivision to set aside land for <br />parks, playground, schools, libraries, municipal buildings, and similar public and semipublic <br />uses, subject to the following regulations: <br /> <br />A. Subdividers shall not be required to dedicate land for recreational areas exceeding five <br />(5) percent of the area of the subdivision, exclusive of street and drainage reservations, <br />except on a reimbursement basis. <br /> <br />B. If subdividers are required to reserve land for public purposes other than streets, <br />drainage, parks or playgrounds, they shall be required to give an eighteen-month <br />option to the city for the purchase of the property involved. If the city does not exercise <br />said option, the land may be sold as lots for the same purpose for which the subdivision <br />was platted. To facilitate such possible eventual sale of reserved land as separate lots, <br />the subdivider shall show on his final plat, by dotted lines and dotted numbers, the <br />area and dimensions of lots to be created within the boundaries of any such reserved <br />land, and may sell such lots, after the expiration date ofthe reservation by lot number, <br />without filing an amended plat. <br /> <br />C. It shall be the responsibility of the city to maintain the land described by this section <br />upon its dedication to the city. <br /> <br />5-38. Identification of wastewater treatment requirements. <br /> <br />Applications for subdivision approval shall identify provisions for wastewater disposition <br />and pretreatment, if required, in accordance with standards of the City of Martinsville. <br /> <br />SECTION 6. APPROVAL OF PLATS-PROCEDURE <br /> <br />6-1. Pre-application procedure. <br /> <br />Previous to the filing of an application for conditional approval of the preliminary plat, the <br />subdivider shall consult early with the agent concerning the subdivision plans of the <br />subdivider. It is the intent of this requirement that the subdivider may familiarize himself <br />with these regulations, and that the agent and such personnel of the city as may be <br />appropriate and concerned, shall be afforded by the subdivider opportunity to advise and assist <br />the subdivider prior to the preparation of the preliminary plat and related material. <br /> <br />Supp. No. 61 <br /> <br />1742 <br />
