§ 23-44 MARTINSVILLE CODE ~-~ <br /> <br /> (5) The city will be responsible for future maintenance of water and sewer lines con- <br /> structed in conformity with this division. <br /> <br /> (6) In the event of a limited water supply or an overloaded sewer system, the city will <br /> give first priority to service within the corporate limits. <br /> <br /> (7) Water and sewer charges outside the corporate limits will be in accordance with <br /> tariffs established for such service by the council. Water and sewer customers will <br /> contract directly through the city for service and not through any intermediate <br /> group, firm, corporation or other political subdivision. The city will not permit the <br /> t resale of water distributed through its public supply system. <br />(Code 1971, App. D, §§ 5, 6) <br /> <br />Sec. 23-45. Conditions for extensions into subdivisions recorded after April 12, 1955, <br /> or streets dedicated prior to April 12, 1955, but not accepted into state <br /> system. <br /> <br /> (a) Water or sewer extensions into the following areas shall be subject to the require- <br />ments of this section: <br /> <br /> (1) Subdivisions made a matter of record in the circuit court clerk's office of Henry <br /> County after April 12, 1955; and, <br /> <br /> (2) Streets whose rights-of-way have been dedicated or made public thoroughfares prior <br /> to April 12, 1955, but-which streets or rights-of-way have not been accepted into the <br /> primary or secondary system of the state department of highways and transportation. <br /> <br /> (b) The following conditions will be met or agreed to before extensions can be permitted <br />into areas or streets specified in subsection (a) above: <br /> <br /> (1) Subdivisions referred to in subsection (a)(1) or property abutting streets referred to in <br /> subsection (a)(2) shall be platted in conformity with the requirements of appropriate <br /> provisions of section IV of the subdivision ordinance. The council will refer plats of <br /> the property to the planning commission for review and recommendation to the <br /> council. Construction of the water and sewer lines will not be allowed, until a final <br /> plat which meets the design standards of section VI of the subdivision ordinance has <br /> been duly recorded.* <br /> <br /> (2)' Jointly with a water extension, sanitary sewer lines will be constructed to serve all <br /> lots where there can be gravity flow to an existing city public sewer line or to the <br /> proposed location of an outfall sewer line as may be planned by the city. The con- <br /> struction of sewer lines in anticipation of an outfall shall not constitute an obligation <br /> upon the city to construct such an outfall. <br /> <br /> (3) Rights-of-way of streets will be graded to a minimum width of forty (40) feet, with the <br /> centerline gradient profile to be approved by the city engineer. <br /> <br /> (4) Water and sewer lines will be laid according to city specifications as to size and type <br /> of pipe and fittings, fire hydrants, depth, location and grade alignment of pipe and <br /> <br /> *Cross reference--Subdivision ordinance, App. A. <br /> <br />1372 <br /> <br /> <br />
