§ 23-31 MARTINSVILLE CODE <br /> <br />Sec. 23-31. Ownership of improvements. <br /> <br /> All street base material, water and sewer lines, storm drain systems' and such other <br />improvements as may be made or required under the conditions of this division will become <br />property of the city upon completion and approval by the city of such construction. <br />(Code 1971, App. C, § 4) <br /> <br />Secs. 23-32--23-36. Reserved. <br /> <br />DIVISION 3. EXTENSIONS OUTSIDE CITY <br /> <br />Sec. 23-37. Definition. <br /> <br /> As used in this division, the term "applicant" shall mean a person desiring a water or <br />sewer extension under this division and who is in a position to assume the responsibility and <br />cost therefor and the term "extension" includes the connection of existing utility lines, <br />outside the corporate limits, with the city system. <br />(Code 1971, App. D, § 1) <br /> <br />Sec. 23-38. Applicab~ity of division. <br /> <br /> It shall be the intent of the council, in the application of this division, that there be an <br />orderly and planned development of land adjacent and nearby to the City. <br />(Code 1971, App. D, § 8) <br /> <br />Sec. 23-39. Compliance with division and related ordinances; individual consider- <br /> ation by council. <br /> <br /> The city council will consider allowing its water and sewer lines to be extended beyond <br />the corporate limits of the city, provided compliance with the provisions of this division and <br />other related ordinances of the city is secured. Each such extension shall be subject to <br />individual consideration by the council and subject further to the city's agreements with the <br />Henry County Public Service Authority as to water service (dated August 10, 1982) and as to <br />sewage treatment (dated January 22, 1974). <br />(Code 1971, App. D, § 1) <br /> <br />Sec. 23-40. Proceedings to prevent, abate, etc., violation of division, <br /> <br /> In case of any violation of the provisions of this division or of any of the provisions of <br />regulations adopted as supplemental to this division, the council or some proper city official, <br />in addition to-other remedies, may institute any appropriate action or proceeding to prevent <br />such violation or attempted violation, to reclaim, correct or abate such violation or attempted <br />violation, or to prevent any at which would constitute such a violation. <br />(Code 1971, App. D, § 9) <br /> <br />Sec. 23-41. Requirements of existing system. <br /> <br /> The council will consider water and sewer extensions or connections in areas outside the <br />city only when the adequacy of the existing water and sewer system is such that the antici~ <br /> <br />'1370 <br /> <br /> <br />
