§ 17-11 MARTINSVILLE CODE <br /> <br />bartering or offering to barter any goods, wares or merchandise, or offering services to be <br />performed in the future for the making, manufacturing or repairing of any article or thing, <br />shall be deemed a solicitor. <br /> <br />(Code 1971, § 14-1) <br /> <br />Sec. 17-12. Violations of article. <br /> <br /> Unless otherwise specifically provided, a violation of any provision of this article shall <br />constitute a Class 1 misdemeanor. <br /> Cross reference--Penalty for Class 1 misdemeanor, § 1-11. <br /> <br />Sec. 17-13. Exemptions from article. <br /> <br /> This article shall not be construed to apply to any person selling farm or domestic <br />products grown or produced by such person, provided such person is exempt from tax as a <br />peddler under the license tax ordinance of the city, nor shall this article be construed to apply <br />to any person or any employee of any person having a permanent place of business in the city <br />and holding a current city business license, nor to any solicitation for bona fide charitable or <br />religious purposes, nor to any newspaper carrier, nor to any person defined as a wholesale <br />peddler by the city license tax ordinance. <br />(Code 1971, § 14-1) <br /> Cross reference--License tax ordinance, Ch. 11. <br /> <br />Sec. 17-14. Article does not affect licensing requirements. <br /> <br /> Nothing in this article shall relieve any person of the necessity of obtaining a business <br />license from the commissioner of revenue, if so required, or of paying any license tax or fee <br />lawfully imposed. <br /> Cross reference--Licenses, Ch. 11. <br /> <br />Sec. 17-15. Inability of chief of police to discharge responsibilities under article. <br /> <br /> If the chief of police is unable to personally discharge any responsibilities under this <br />article because of illness, absence from the city or otherwise, such responsibilities shall be <br />carried out by the assistant chief of police or any other officer specifically designated by the <br />chief. <br />(Code 1971, § 14-12) <br /> <br />Sec. 17-16. Responsibility of employers for acts of solicitors. <br /> <br /> Any person who employs another person to operate as a solicitor under a permit issued <br />under this article, as well as the employer of any person selling, soliciting or taking orders <br />without a permit, shall be held responsible and liable for the acts of his employees and shall <br />be deemed in violation of this article in the same manner as though he were the actual <br />employee in question. <br /> <br />Secs. 17-17--17-21.
