§ 13-30 MARTINSVILLE CODE <br /> <br />Sec. 13-30. Damaging shrubs, plants, etc., on public property. <br /> <br /> (a) It shall be unlawful and a Class I misdemeanor for any person to wilfully break, <br />destroy, deface, mutilate or injure any shrub, plant, flower or other ornamental growth in any <br />park, street or public ground within the city. <br /> <br /> (b) This section shall not apply to any act or work done in accord with a permit issued by <br />the director of public works under Chapter 19 of this Code. <br />(Code 1971,. § 15-9) <br /> Cross reference--Penalty for Class I misdemeanor, § 1-11. <br /> <br />Sec. 13-31. Altering surface of road or other public property; obstructing drainage. <br /> <br /> (a) It shall be unlawful for any person to alter in any way the existing surface of any <br />public road, right-of-way, drainage easement or other public property in the city, unless such <br />person first obtains permission for such alteration from the planning commission. The plan- <br />ning commission or its agent shall specify what alterations may be made and shall also <br />specify the condition upon which such alterations shall be made in order to ensure the <br />satisfactory completion of such work in the interest of the general public. <br /> <br /> (b) No person shall obstruct any ditch, road, swale, public right-of-way, watercourse or <br />drainage easement in such a manner as to interfere with the natural flow of water or to cause <br />any stoppage or impediment to the natural flow thereof across and along such ditch, road, <br />swale, public right-of-way, watercourse or drainage easement. <br /> <br /> (c) It shall be unlawful for any person, without lawful authority first obtained, to destroy, <br />injure, close up, dam up or stop up, or cause to be destroyed, injured, closed up, dammed up or <br />stopped up, or to interfere with in any way any ditch, drain, catch basin, pipe or any part of <br />the surface drainage system of the city, whether upon city property or upon private property, <br />so as to cause water, soil or debris to be dammed up, backed up or deposited upon the property <br />of others, or upon the streets, alleys, sidewalks or public grounds of the city. <br /> <br /> (d) Any person violating any provision of this section shall be guilty of a Class i misdemeanor. <br />(Code 1971, § 17-1) <br /> Cross references--Penalty for Class I misdemeanor, § 1-11; raising or lowering grade of <br />street or sidewalk so as to affect abutting property, § 19-4. <br /> <br />Sec. 13-32. Injuring, tampering with, etc., vehicles, boats, etc. <br /> <br /> (a) Any person who shall, individually or in association with one or more others, willfully <br />break, injure, tamper with or remove any part of any vehicle, aircraft, boat or vessel, for the <br />purpose of injuring, defacing or destroying such vehicle, aircraft, boat or vessel, or temporar- <br />ily or permanently preventing its useful operation, or for any purpose against the will or <br />without the consent of the owner of such vehicle, aircraft, boat or vessel, or who shall in any <br />other manner willfully or maliciously interfere with or prevent 'the running or operation of <br />such vehicle, aircraft, boat or vessel, shall be guilty of a Class i misdemeanor. <br /> <br /> (b) Any person who shall, without the consent of the owner or person in charge of a <br />vehicle, aircraft, boat, vessel or locomotive or other rolling stock of a railroad, climb into or <br /> <br />800 <br /> <br /> <br />
