Removal of vehicles against which there are outstanding parking violations. <br /> <br />Whenever any motor vehicle is found parked upon the public streets or highways of the <br />city or in any municipal parking lot, against which 8uchvehicle there are three (3) or more <br />outstanding unpaid or otherwise unsettled parking violation citations, such vehicle may, by <br />towing or otherwise, be removed and taken to any garage or impoundment area to be stored. <br />The removal of the vehicle shall be by or under the direction of an officer of the police <br />department. It shall be the duty of the police officer removing such motor vehicle, or under <br />whose direction such vehicle is removed, to inform, as soon as practicable, the owner of the <br />removed vehicle of the nature and circumstances of the prior unsettled parking violation <br />citations, for which or on account of which such vehicle was removed. The owner of such <br />removed vehicle, or other duly authorized person, shall be permitted to repossess or to secure <br />the release of the vehicle by payment of the outstanding parking violation citations for which <br />the vehicle was removed and by payment of allreasoilable cost incidental to the removal and <br />storage ofthe vehicle and the efforts to locate the owner of the vehicle. Contracts with private persons for removal and storage of vehicles <br />under article. <br /> <br />, <br />\ ," ' <br />The city shall have the power to enter into contr~cts with the owner or operator of <br />garages or other places for the removal and storage of vehicles pursuant to the provisions of <br />this article. The contracts shall provide for the payment by the city of reasonable charges for <br />the removal and storage of such vehicles. shall require the owners or operators of the garages <br />or other places to deliver such vehicles back to the owners thereof upon the release of the <br />vehicles by the police, upon payment of all removal and storage charges and upon furnishing <br />satisfactory evidence of identity and ownership or agency . The contracts shall further provide <br />that the owners or operators of such garages or places of storage will indemnify the owners of <br />such vehicles for injury or damage thereto resulting from negligence in the removal or storage <br />thereof, and such owners or operators shall be required to provide themselves with adequate <br />liability insurance to cover such indetnnity. <br />(Ord. of 2-24-81. ~ 10-117.2) <br /> <br />Secs. 12-117-12-126.
