<br />(0, <br /> <br />n, <br />I <br /> <br />('\ <br /> <br />MOTOR VEHICLES AND TRAFFIC <br /> <br />~ 12-114 <br /> <br />(c) For the purposes of this section, it shall be presumed that such motor vehicle, trailer <br />or semitrailer, or part thereof, is abandoned if it lacks either a current state license plate, a <br />current county, city or town plate or sticker or a valid state inspection certificate or sticker <br />and has been in a specific location for ten (10) days without being moved. <br /> <br />(<1) Each removal under.this section shall be reported immediately to the chief of police, <br />and notice thereof given t.o the owner of the motor vehicle, trailer or semitrailer as promptly <br />as possible. The owner of such vehicle or trailer or semitrailer, before obtaining possession <br />thereof, shall pay to the city aU reasonable cost incidental to the removal, storage and locating <br />the owner of the vehicle, trailer or semitrailer. Should such owne.r f~il or refuse to pay the cost <br />or should the identity or whereabouts of such owner be unknown and unascertainable after a <br />diligent search has been made, and after notice to him at his last known address and to the <br />holder of any lien of record in the office of the state division of motor vehicles against the <br />vehicle, trailer or semitrailer, the chief of police may, after holding, the vehicle, trailer or <br />semitrailer forty (40) days and after due notice of sale, dispose ofthe same at public sale and <br />the proceeds from the sale shall be forwarded by the chief of police to the city treasurer; <br />provided, however, that if the value of such vehicle, trailer or semitrailer is determined by <br />three (3) disinterested dealers or garagemen to be less than one hundre~ fifty dollars ($150.00), it <br />may be disposed of by private sale or junked. <br /> <br />(e) Any personal property found in any unattended or abandoned motor vehicle, trailer or <br />semitrailer may be sold incident to the sale of such vehicle pursuant to this section. <br /> <br />(f) The city treasurer shall pay, from the proceeds of any sale under this section, the cost <br />of removal, storage, investigation as to ownership and liens and notice of sale, and the balance <br />of such funds shall be held by him for the owner and paid to the owner upon satisfactory proof <br />of ownership. <br /> <br />(g) If no claim has been made by the owner for the proceeds of a sale under this section, <br />the remaining funds shall be deposited to the general fund of the city. Any such owner shall <br />be entitled to apply to the city within three (3) years from the date of such sale and, if timely <br />application is made therefor, the city shall pay the same to the owner without interest or other <br />charges. Removal of vehicles obstructing traffic or parking spaces. <br /> <br />Whenever any police officer finds a vehicle stopped upon any public street or highway or <br />on any municipal parking lot in such a manner as to constitute an obstruction to traffic or <br />block access to parking spaces, such officer may require the owner, driver or person in charge <br />of the vehicle to remove the same to a position off of the paved or traveled portion of such <br />street, highway or lot, or may have such vehicle removed, by towing or otherwise, to a licensed <br />garage for storage until called for by the owner or his agent.
