<br />~ 12-104 <br /> <br />MARTINSVILLE CODE <br /> <br />Sec. 12-104. Satisfaction of uncontested parking citations. <br /> <br />Uncontested parking citations shall be satisfied by paying the appropriate penalty to the <br />city treasurer within seven (7) calendar days after the issuance of the citation. <br />(Ord. of2-24-81, ~ 10-109) <br />State law reference-Uncontested payment of parking citation penalties, Code of Vir- <br />ginia, ~ 46.2-1225 et seq. <br /> <br />Sec. 12-105. Contest of parking citations. <br /> <br />(a) Any person receiving a parking citation shall have been seven (7) calendar days after <br />the issuance of the citation in which to contest the citation. If the citation is not contested <br />within this period, the person receiving the citation shall be barred from contesting the <br />issuance of the citation in any future proceeding, including any proceeding for the nonpayment <br />of the citation penalty. To contest the parking citation, the contesting party shall file a notice <br />of the parking citation contest in the city treasurer's office on a form to be provided by the <br />treasurer. Such form shall require the contesting party to furnish his name and address, the <br />date and number of the citation being contested and the grounds upon which he contests the <br />citation. The treasurer shall immediately obtain a court date for a trial of the parking citation <br />contest in the general district court or, in the case of a juvenile, in the juvenile and domestic <br />relations district court. The court date shall be written on the form and the contesting party <br />shall be required to sign a written promise to appear in court at the time and date specified. <br />The treasurer shall certify the original of the form to the clerk's office of the appropriate <br />district court, shall furnish copies of the form to the contesting party and to the police <br />department and shall retain a copy for his files. Upon the filing of a parking citation contest, <br />no further action shall be taken to enforce payment of the penalty for the citation until after <br />the court decides the matter. <br /> <br />~ <br /> <br />(b) Upon the trial of the parking citation contest, if the trial judge shall decide that the <br />citation was not lawfully issued, he shall declare the citation void; otherwise he shall declare <br />the citation valid and shall order the penalty provided for the violation to be paid to the city <br />treasurer by the following business day after the trial. The clerk of the district court trying the <br />case shall promptly notify the treasurer of the court's decision and the treasurer shall record <br />such on his copy of the form. <br />(Ord. of 2-24-81, ~ 10-110) <br />State law reference-Certification of contested parking citation, Code of Virginia, <br />~ 46.2-1225 et seq. <br /> <br />Sec. 12-106. Failure to payor contest parking citation within seven days. <br /> <br />(a) It shall be unlawful for any person to fail or refuse to payor contest any parking citation <br />issued pursuant to this article within seven (7) calendar days after its issuance.
