<br />~ 7-11 <br /> <br />MARTINSVILLE CODE <br /> <br />Sec. 7-11. Unauthorized use of electricity. <br /> <br />If any person shall, without authority from the city, connect or turn on electricity from the <br />city system into any premises, or if any person receives or uses electricity from the city system <br />knowing that he is not authorized to use such current by the city or some person responsible <br />therefore, he shall be guilty of a Class 1 misdemeanor. <br />(Code 1971, ~ 5-1) <br />Cross reference-Penalty for Class 1 misdemeanor, ~ 1-11. <br /> <br />Sec. 7.12. Liabilities. <br /> <br />(a) City's liability. The electric department shall use reasonable diligence in attempting to <br />furnish a regular and uninterrupted supply of electrical energy to its customers; however, in <br />the event such supply is interrupted or fails by reason of an act of God or an act of a public <br />enemy, or by reason of accidents, strikes, legal process, state or federal interference, <br />breakdowns or injury to machinery or transmission or distribution equipment or lines, or by <br />occasion of extraordinary repairs, the city shall not be liable for damages. The city shall not be <br />liable for any loss, injury or damage resulting from use by the customer of his equipment or <br />from use of electrical energy supplied by the city or from connections of the city wires with the <br />customer's building, wires, appliances or equipment. The city will provide and maintain in <br />proper operative conditions the necessary line or service connections, transformers, meters <br />and other apparatus which may be required for proper measurement of and protection to its <br />service. All such apparatus shall be and remain the property of the city. The city shall not be <br />responsible for any damages, if caused by a reversal of current, unless the reversal of current <br />is a direct result of negligence on the part of the electric department or its employees. <br /> <br />(b) Customer's liability. In the event of loss of or injury to the city's electrical properties <br />through misuse by or negligence of the customer or his employees, the cost of the necessary <br />repairs or replacement thereof may be assessed against and collected from such customer. <br />Customers will be held liable for and responsible for, according to law, tampering or interfering <br />with or breaking of seals of meters, or otherwise damaging or tampering with city-owned <br />equipment installed on the customer's premises. <br />(Code 1971, ~ 5-11) <br /> <br />Supp. No. 58 <br /> <br />438 <br /> <br />[The next page is 463] <br />
