GENERAL PROVISIONS § 1-15 <br /> <br />docketing, indexing, etc., any warrants, summonses or papers evidencing such violations as is <br />required in the matter of the same evidencing state violations. <br />(Code 1971, § 1-7; Ord. of 1-12-82) <br /> <br />Sec. 1-14. Dismissal of prosecutions; retraxit. <br /> <br /> When a person is in jail or under a recognizance to answer a charge ef assanlt and battery <br />or other misdemeanor, or has been indicted for an assault and battery or other misdemeanor, <br />for which there is a remedy by civil action, unless the offense was committed by or upon the <br />city sheriff, any police officer, deputy sheriff, clerk or judge, or riotously, or with intent to <br />commit a felony, if the party injured appears before the judge who made the commitment or <br />took the recognizance, or before the court in which the indictment or warrant is pending, and <br />acknowledges, in writing, that he has received satisfaction for the injury, such judge or court <br />may, in his or its discretion, by an order, supersede the commitment, discharge the recagni- <br />zance and dismiss the prosecution, upon payment by the defendant of all costs accrued to the <br />city or the court. <br />(Code 1971, § 11-11) <br /> State law reference-Similar provisions, Code of Virginia, § 19.2-151. <br /> <br />Sec. 1.15. Special court costs assessments. <br /> (a) Law library. <br /> <br /> (1) Two dollars ($2.00) shall be assessed, as part of the costs incident to each civil action <br /> filed in both the courts of record and the courts not of record in the city, pursuant to <br /> section 42.1-70 efthe Code of W~rginia. Such assessment shall be collected by the clerk <br /> of the court in which the action is filed and such collections shall be remitted, at the <br /> end of each month, to the city treasurer, to be deposited and held by such treasurer <br /> subject to disbursements authorized by the city council or its agent for the acquisition <br /> of law books and law periodicals for the establishment, use and maintenance of a law <br /> library, which library shall be open for the use of the public, and for such other <br /> purposes as are allowed by section 42.1-70 efthe Code of Virginia. <br /> <br /> (2) The assessment provided for in this section shall be in addition to all other costs <br /> prescribed by law, but shall not apply to any action in which the commonwealth or any <br /> political subdivision thereof or the federal government is a party and in which the costs <br /> ere assessed against the commonwealth or any political subdivision thereof or the <br /> federal government. <br /> <br /> (b) Jail and court.related facilities; construction, maintenance, etc. <br /> <br /> (1) The sum eftwo dollars ($2.00) be, and it hereby is, assessed as part of the costs in each <br /> civil action filed in the general district court of the city, the juvenile and domestic <br /> relations district court efthe city, and the circuit court of the city, and in each criminal <br /> and traffic case in said general district court, juvenile and domestic relations district <br /> court or said circuit court in which the defendant is charged with a violation of any <br /> statute or ordinance, which assessment shall be collected by the clerk of the court in <br /> <br />Supp. No. 53 93 <br /> <br /> <br />
