It was the opinion <br />of City Attorney Dave Worthy that the'railroad right-of-way was not real property but that they <br />should have been duly notified. The Norfolk Southern Corporation and other adjacent property <br />owners were notified of this second public hearing. No opposition was received regarding the <br />request. Attorney Ward Armstrong, representing the petitioners, said none of the facts for the <br />special use request were different from the previous hearing. Attorney Cheryl Pence with <br />American Tower Corporation reported the temporary facility, Cell on Wheels (C.O.W.), would <br />be used for an interim time of 30 to 45 days from the date of Council's approval. Member Hall <br />made a motion, seconded by Member Williams, to recommend to Council the approval of this <br />special use request with the following conditions: 1) The mature vegetation to the noah and west <br />of the proposed facility remain as a visual barrier; 2)The color of the new monopole will be <br />industrial gray: 3) If lighting is required on the monopole, by the FAA, the light will be <br />positioned to reflect upward; 4) A landscaping plan around the facility will be submitted for <br />approval by the Planning Commission staff; 5) Any changes to the design of this facility or its <br />conditions will be submitted for approval to the Martinsville Planning Commission; 6) The <br />proposed facility will be 40 feet by 40 feet in size; 7) Evidence that the proposed structure will <br />have bond or insurance coverage of at least $100,000 to adequately cover any damages that may <br />be caused by the monopole or its radio frequencies; 8) Proper signage shall be installed on the <br />fencing surrounding the facility to ward off any trespassers; 9) The new monopole will allow <br />collocation (4 providers). The motion passed (5-0) with Member Martin abstaining from the <br />vote. <br /> <br /> There being no further business, the meeting adjourned 1:20 p.m. <br /> <br /> <br />
