TUESDAY, JANUARY 24, 1989 <br /> <br />whether the Commission's recommended land use designation of R-9 for the City's <br />service area (as defined in the City's agreement with the Henry County Public <br />Service Authority) situated along the relocated Spruce Street project, along <br />which the City constructed a new water line, should be changed or that some <br />variance be granted for existing developed properties within that area. Of the <br />twenty-one lots abutting the northeast side of the relocated Spruce Street <br />(and, partially, the former Spruce Street right-of-way), ten lots are currently <br />"actively" occupied, for the most part with single-family residences. At the <br />public hearings held on the relocation of Spruce Street, prior to its' <br />reconstruction, Mr.'Brown reported it was anticipated that properties situated <br />in Henry County but adjacent to the relocated street would be allowed to <br />connect to the then-proposed new water line, which line was designed to improve <br />water flow in the entire area and cost of $30,000.00. Mr. Frank Barnes, owner <br />of one of the abutting properties and a resident thereof for over thirty years, <br />present at this meeting, informed Council that the privilege of connecting to <br />the City's water line was his understanding; whereas, Mr. Robert Gravely, also <br />present and owner of several abutting properties, indicated that for any future <br />developments of his properties he will comply with the R-9 designation <br />recommended by the Planning Commission and accepted by City Council at <br /> <br />Council's regular meeting held September 27, 1988. Councilman Cole then raised <br />questions as to why R-9 was recommended by the Planning Commission for this <br />area; why might it not have been R-6; are there restrictive covenants in force <br />elsewhere outside the City where City water and sewer services are provided <br />and, if so, what do these covenants require; whether the original ordinance <br />governing "outside" services and connections has any import or meaning; and why <br />the proposed amending ordinance would provide for removal of the surcharge <br />feature.
