TUESDAY, DECEMBER 13, 1988 <br /> <br />Service Authority which provide for water and sewer services in areas outside <br />the City but abutting the city's corporate limits, with such areas being <br />defined as "service" areas, City Attorney Worthy stated that in such cases in <br />which the. City has the right to serve but refuses to serve because applicants <br />will not comply with restrictive covenants the City might prescribe (such as to <br />assure that "outside" development will be compatible with nearby in-City <br />development), the Henry County PSA has the right (under agreements with City) <br />to serve. In the case of water service in these circumstances, the PSA may <br /> <br /> "Cit" <br />connect to the City's mains and relay y treated water to the applicant or <br /> <br />applicants who then would be customers of the PSA. Both Messrs. Ford and Adams <br />(of the Planning Commission) cited the Commission's responsibility of <br />attempting to plan for appropriate development of outside-but-abutting <br />properties as well as the protection of interests of "inside" City residents, <br />with Mr. Ford recommending that Council not "rush into" amending Section 23-44 <br />as proposed. Councilman Groden suggested that the PSA agreements with the City <br />might be amended to coincide, perhaps, with the City's present regulations and, <br />too, that the ordinance under consideration ought to be re-written. Mr. Groden <br />also expressed a preference that subsection (4), providing for surcharges to <br />"outside" business firms who seek and use City water, be retained. Councilman <br />McClain, concurring with Planning Commission Chairman Ford, registered his <br />opposition to proposed Ordinance No. 88-12; however, Mr. McClain stated that he <br />would have no objections, once the Henry County Board of Supervisors adopts a <br />zoning ordinance° A motion, duly seconded, that Council not adopt the proposed <br />amending ordinance, carried by a vote of three-to-two (Mayor Oakes and <br />Vice-Mayor Willjams voting against the motion). <br /> <br /> <br />
