TUESDAY; FEBRUARY 27; 1990 <br /> <br />This statement seems to also apply to the lease amendments as <br />well. Therefore, it would seem that the recording of these maps <br />would meet the above State Code provision. <br /> <br />(e) <br /> <br />No clerk of any court shall file or record a plat of <br />a subdivision required by this article to be record- <br />ed until such plat has been approved as required <br />herein; and the penalties provided by Section 17-59 <br />shall apply to any failure to comply with the provi- <br />sions of this subsection. <br /> <br />It se&ms o~vious that the Clerk considered the map to be a part <br />of the lease rather than a subdivision even though recorded in <br />the map area of the Clerk's Office. <br /> <br />In somewhat of a related matter, Mr. Ford expressed concern with <br />respect to traffic hazards in the area of the Mall, along with <br />additional motor vehicle hazards in the future that will result <br />from the full development of the Mall and other traffic genera- <br />tots within the general area. I would call attention to the <br />Martinsville Transportation Plan which was updated in 1985. This <br />Plan was prepared by the Virginia Department of Transportation <br />(VDOT) and is based on traffic projections through year 2000. <br />The preparation of the original Plan and the 1985 Update were <br />participatedin by the Planning Commission, City Council and the <br />Administration which included the holding of public hearings on <br />the Plan. This document is comprehensive in its design and is <br />the basis for implementing transportation projects designed to <br />meet current and projected traffic needs of Martinsville and the <br />urban area of Henry County which includes the Mall area. The <br />road pro3ects that have been implemented, as well as those to be <br />costructed in the future will be based on this Plan. Highway <br />projects that have been constructed in the Mall area are in <br />accordance with this Plan. As a matter of fact, funding from <br />the State for projects in cities such as Martinsville cannot be <br />obtained unless such projects are .shown on the Thoroughfare <br />Plan. Another update of this Plan should be undertaken in the <br />near future. Any traffic problems in the Mall area should <br />rightfully be considered at that time. We are very pleased with <br />the traffic flow situation in the Mall area at this time. The <br />design of the Mall entrances, crossovers and turning lanes are <br />working well, in our opinion. The new signal at Market and <br />Commonwealth now scheduled will further improve traffic flow and <br />safety in this area. There is some build up of traffic during <br />peak traffic periods. This is not unusual fop this and many <br />other locations in the City. <br /> <br />In summary, we feel that the Administration enforced the Zoning <br />Ordinance legally and pPoperly with respect to the development <br />of Liberty Fair Mall. We do not feel that the Administration <br />was or should have been involved with the Subdivision Ordinance <br /> <br /> <br />
