270 <br /> <br />TUESDAY, FEBRUARY 27, 1990 <br /> <br />CITY OF MARTINSVILLE <br /> <br />DATE: <br /> <br />TO: <br /> <br />FROM: <br /> <br />SUBJECT: <br /> <br />February 27, 1990 <br /> <br />Honorable Mayor and City Council <br /> <br />George W. Brown, City Manager <br /> <br />James H. Ford's Letter to City Council dated <br />February 19, 1990, regarding Liberty Fair Mall <br /> <br />By letter directed to City Council dated February 19, 1990, Mr. <br />James H, Ford, Attorney and Chairman of the City Planning <br />Commission, made a number of allegations with respect to the <br />manner in which the City Administration has applied or enforced <br />ordinances and State laws relative to the development of Liberty <br />Fair Mall. We take strong issue and exception to Mr, Ford's <br />statement that "our administrative staff is continuing to be <br />quite arbitrary in the administration and enforcement of our <br />ordinances and State laws relating to subdivisions and land <br />use". This statement, in our opinion, questions the integrity <br />of those of the Administration who are charged with the proper <br />administration of these ordinances. This includes me as City <br />Manager, since the City Charter states that, <br /> <br />The City Manager shall be responsible to the Council <br />for the proper administration of all affairs of the <br />City coming under his jurisdiction, under this Charter, <br />the general laws or the ordinances or resolutions of <br />the Council. He shall have power and it shall be his <br />duty: (a) To see that all laws and ordinances are <br />enforced. <br /> <br />I take this responsibility very seriously and am, therefore, <br />concerned and resent any statement that states or implies that <br />the Administration is intentionally administering the laws and <br />ordinances of the City in an arbitrary manner. I have full <br />confidence in those in City government who are in anyway charged <br />with the enforcement of the laws and ordinances of the City and <br />the Commonwealth. This is not to say that any of us are <br />infallible and are, therefore, subject to making mistakes in <br />interpreting ordinances, etc. However, I assure all concerned <br />that it is never our intention to circumvent any law or ordi- <br />nance in a manner that would Favor anyone. It's inconceivable <br />For me to even think that any of our officials charged with <br />enforcement of ordinances, laws, etc., would intentionally <br />violate the trust of their office by Failing to carry out their <br />responsibilities in a Fair and uniform manner. <br /> <br />55 WEST CHURCH STREET <br /> <br />P.
