TUESDAY, JANUARY 23, 1990

BE IT ORDAINED by the Council of the City of Martinsville, Virginia,
in regular session assembled, January 23, 1990, that it does hereby
amend the City's Zoning Ordinance, Section X~ Signs, Paragraph D.
Signs Permitted in Districts, Sub-section 5. C-2 District, Sub-
paragraph a., as follows:

D. Signs Permitted in Districts

5. C-2 District:

Two non-illuminated accessory signs for each premises,
which sign may beeither wall- or roof-mounted. This
shall not be construed to include or allow a sign painted
on a building. In lieu of separate signs, letters may be
engraved in the surface of a building,~ or separate carved
letters may be attached to the face of a building; and, in
addition to the foregoing, signs on marquees and awnings,
as defined in Section X, Part B,~ are permitted, provided
that the total combined area of all signs shall not exceed
three (3) square feet for each linear.foot of building
frontage.

Council considered a request by McCauley Aron, Jr., seeking relief from charges
imposed by the City for relocating a power line crossing his property abutting

Sam Lions Trail. City Manager Brown stated thatin 1935 Appalachian Power

Company (APCo) secured easements from Lanier Farm for erection of power lines.

Said easements (1) gave APCo general privilege and right to extend lines across

reserved areas,' through alleys, streets, etc.; and (2).provided for easements
at th~ back of lots along various streets. After annexation in 1939, the City

purchased APCo's holdings in the area, along with the easements. This particu-

lar parcel of land, now designated as 1008 Sam Lions Trail or Lot 5, was part
of a larger parcel that had been designated by Lanier Farm as a "reserved"

area. In 1965, this parcel of reserved land was subdivided, leaving a power

line and pole running through Lot 5, therefore, inorder for Mr. Aron to con-

struct a house, the pole hasto be relocated along the near east boundary of
this lot. The City's policy regarding this type of power line relocation
requires that the cost be borne by the property owner. If any changes are made
