TUESDAY, JANUARY 9, 1990 <br /> <br />unanimously carried, Council accepted Adelphia Cable Communication Company's <br />proposal to limit the pass through charge to customers to 3.'7% of the use <br />charges for the remainder of the Franchise (until January 1, 1992), thus <br />reimbursing or crediting the customers for any Overcharges. The City would, <br />however, continue to receive the regular 5% annual Franchise Fee as pres'cribed <br />in the current Franchise. <br /> <br />In a related matter the City Manager set forth the procedure to be followed <br />under the Federal Communications Act in renewing the Cable Franchise, noting <br />that the first step was for Adelphia to submit a proposal to renew the <br />Company's Franchise which expires January 1, 1992. The Mayor appointed <br />Councilmen Allan McClain and Alfred T. Groden, City Manager George W. Brown and <br />City Attorney David B. Worthy to comprise a Committee to review and negotiate <br />with Adelphia a new franchise for cable service in Martinsvilleo It was noted <br />that after agreement has been reached between the Cable Company and the <br />Committee the matter would be brought to Council for consideration, after which <br />public hearings would be scheduled in order to give the public an opportunity <br />of input and to express concerns that they might have before the new franchise <br />is approved in final form. <br /> <br />Continuing a discussion from the December 12, 1989, meeting regarding a <br /> <br />recommendation from the Commercial Development Commission that parking be <br />limited to one hour behind Jefferson Plaza as the result of a request from Mr. <br />William F. Franck, owner of the property, Council heard from several merchants <br />in the affected area of downtown. There were concerns expressed that students <br />of National Business College were using the parking lot behind Jefferson Plaza <br /> <br /> <br />
