150 <br /> <br />TUESDAY, SEPTEMBER <br /> <br />26, 1989 <br /> <br />SECTION 7. USE OF STREETS <br /> <br /> (a) General Control and Location of Gas Mains and Pipes. The <br /> grantee, in any opening it shall make in the streets in the city, shall be <br /> su~.ject to the provisions of this franchise, and to all applicable City <br /> ordinanc.es.and regulations. The city reserves the right by resolution or <br /> otherwi'.~>2~o:'?d~Signate the location of any gas mains or gas service lines, with <br /> referen'c~t:o~6~r municipal street facilities such as sewer and water mains, <br /> electric poles ~a lines and other services, in such a manner as to promote the <br /> public safety and to protect public property. The grantee shall not have the <br /> right to lay its gas mains or pipes in the same ditch in which water or sewer <br /> lines or pipes are laid unless it shall secure the written consent of the city <br /> in each specific instance. The grantee shall so construct and locate mains and <br /> pipes as not to interfere with the.construction, location, and maintenance of <br /> sewer or water connections or sewer or water mains. Any designation of <br /> location authorized here in shall be accomplished by the city so as not <br /> unnecessarily to delay the grantee in any of its operations. The city also <br /> reserves the right to approve the locations, if within the city, of any new <br /> regulator station of the grantee and of any mains carrying a pressure of 25 <br />pounds or more, but such approval shall not be unreasonably withheld. <br /> <br />(b) Disturbance of Streets - Restoration. <br /> <br /> (1) The City Council may require that written permits, <br />in any or all cases, be obtained by the grantee from the Director of <br />Public Works of the city, whenever it becomes necessary to excavate in the <br />public streets or p~blic grounds of the city in order to install, <br />construct, extend~ or repair any of the grantee's gas mains or pipes or <br />services now located, or to be in the future located, therein or thereon. <br />Such permits, if required, may be applicable to any or all types of <br />excavations as prescribed by the City Council. Such permits, further <br />shall state the particular part or point of the street where said <br />excavation is to be made and the length of time in which such permit shall <br />authorize such work to be done. An exceptionto requirement for permit <br />shall be made in cases of emergencies involving public safety. <br /> <br /> (2) Immediately after the gas mains and pipes are <br />installed or repaired,.the trenches in which said gas mains and pipes are <br />located shall be refilled by the grantee. Backfilling of trenches shall <br />consist of placing fill material in layers not to exceed six inches in <br />depth with each layer thoroughly tamped with approved air or hand <br />tampers. The top twenty-four inches of all trenches shall be backfilled <br />entirely with No. 21 or 21A stone (crusher run). For backfilling below <br />and up to a twenty-four inch depth, backfill shall be earth, free from <br />large lumps, stones, and other objectionable matter, and shall contain <br />only enough moisture to readily compact to the density of the original <br />earth. Non-suitable and surplus trench material shall be removed by the <br />grantee. Where necessary, temporary surfacing shall be placed in such <br /> <br /> <br />
