TUESDAY, JULY 25, 1989 <br /> <br />That off-street parking be provided on the basis of one <br />(1) space for each employee and two (2) spaces for <br />visiting medical and/or dental personnel; and <br /> <br />That off-street loading and/or unloading area be provided <br />equivalent to one hundred fifty (150) square feet per <br />adult. <br /> <br />Council unanimousl'y adopted the following ordinance, identified as Ordinance <br />No. 89-8 as introduced and placed on first reading by Council at its recent. <br />July llth meeting, to regulate "going-out-of business" sales in the manner set <br />forth therein: <br /> <br />WHEREAS Sections 18.2-223 and 18.2-224 of the 1950 Code of Virginia, <br />as amended, provides that every county, town and city shall issue a <br />permit. for special sales to retail merchants for "Going out of <br />business" sales upon the application of such merchant; and <br /> <br />WHEREAS, Section 18.2-225 provides that each county,town or city is <br />authorized to charge a fee for the issuance of special sales permits <br />not to exceed sixty-five dollars ($65.00) for each permit; and <br /> <br />WHEREAS, there is a need for the City of Martinsville to regulate and <br />monitor such sales and to comply'with the provisions of the aforesaid <br />statutes; now, therefore, <br /> <br />BE IT ORDAINED by the Council of the City of Martinsville, Virginia, <br />in regular session assembled on July 25, 1989, that anordinance <br />governing the issuance of "Going out of business" sales permits is <br />hereby enacted by adding Section 13-40, "Going out of business" sale <br />permits, to Chapter 13, Offenses-- Miscellaneous, of the City Code, <br />as follows: <br /> <br />"GOING OUT OF BUSINESS" SALES; PERMIT REQUIRED. It shall be <br />unlawful for any person to advertise, or conduct, a sale for the <br />purpose of discontinuing a retail business, or to modify the word <br />"sale" in any advertisement with the words "going out of <br />business"or any other words which tend to insinuate that the <br />retail business is to be discontinued and the merchandise <br />liquidated, unless such person obtains a permit to conduct such <br />sale from the City. <br /> <br />A violation of the provisions of this section shall be punishable <br />as a Class 1 misdemeanor. <br /> <br />INSPECTIONS; APPLICATION FOR PERMIT; INVENTORY REQUIRED; <br />COMMINGLING OF OTHER GOODS PROHIBITED; DURATION; ADDITIONAL <br /> <br /> <br />
