TUESDAY, JUNE 25, 1991 <br />CounCil Considered adoption of a Resolution granting Central Telephone <br />Company of Virginia (Centel) the right to continue operating in Martinsvilie <br />unt'ii a new Franchise Ordinance is adopted. Mr. Brown reported that on <br />November 6, 1990 he advised the Telephone Company that their Franchise <br />expires July 15, 1991 and that it would be appropriate for them to prepare a <br />proposed new franchise for the City's consideration. Mr. Brown stated that <br />he had received a draft of a suggested Franchise in May, 1991 from the <br />Telephone Company, but felt that the draft was unacceptable. Mr. Brown <br />reported that his staff had developed a draft that he' felt could be <br />considered, but that due to the lengthy Franchise. review processon the part <br />of Centel, it ~Yould not be possible to negotiate, advertise and adopt ,~ new <br />Franchise Ordinance prior to the expiration of the current Franchise. Mr. <br />Brown recommended adoption of the Resolution. Upon motion, duly seconded and <br />by unanimous vote, Council adopted the following Resolution: <br /> <br />WHEREAS, the franchise of Central Telephone Company of Virginiato <br />operate in the City of Martinsviile, Virginia, expires on july 15, <br />1991; and <br /> <br />WHEREAS, the said Company and the City of Martinsviile are in the <br />process of negotiating a new franchise granting said Company the <br />right to continue to operate in said City and to use the City's <br />streets, rights of way, alleys, avenues, highways, and any other <br />public places in the City for the purpose of 'operating arz.~. <br />maintaining a telephone system including all necessary <br />appurtenances; and <br /> <br />WHEREAS, the time needed for negotiation, bidding, and adVertising <br />for said franchise and the ordinance adopting same, is such that <br />the City will not be able to enact an ordinance adopting said <br />franchise on or before July 15, 1991; and <br /> <br />WHEREAS, said Company will need consent from the Martinsvilie City <br />Council to continue to operate in said City until the ordinance <br />adopting its new franchise is duly enacted by said Council; now, <br />therefore, <br /> <br />BE IT' RESOLVED by the Council of the City of Martinsvi!ie, <br />Virginia, in regular session assembled on June 25, 1991 that <br />Central Telephone Company of Virginia be, and hereby is, granted <br />the consent of the Martinsrifle City Council to continue to operate <br />in said City, and to continue to use the streets, rights of way, <br />alleys, avenues, highways and any other public places in the City <br />for the purpose of operating and maintaining a telephone system <br /> <br /> <br />
