Several members of Council expressed concern <br />that the City and the PSA should have a written understanding such as a <br />letter agreement which summarizes the details of the "buy-in" and the "buy- <br />back" of PSA capacity in the City's Water Pollution Contrgl Plant. Mr. Brown <br />indicated that some form of agreement would be prepared and executed and that <br />a.copy would be brought back to Council for their information. Mr. MadisOn <br />Hubbard, Jr., former Board member of the PSA, stated that the agreements <br />between the City and the PSA regarding water and sewer services have <br />benefitted both parties, and expressed appreciation to all individuals <br />involved in the agreements. Mr. William C. Cole, Jr., former Mayor and <br />Councilman, stated that the water and sewer agreements between the City and <br />the PSA are an "outstanding example of what the City and County can and must <br />do together." Upon motion,.duly seconded and by unanimous vote, Council <br />approved the purchase of one-third capacity in the Henry County PSA's Lower <br />Smith River Interceptor. <br /> <br />Council considered approval of payment of $3,170,643 to "buy-back" 2.27 MGD <br />capacity in the City's Water Pollution Control Plant. Under the buy-back <br />arrangement, the PSA retains 0.40 MGD capacity in the City's plant for <br />current and future use. The buy-back arrangement was approved by the PSA at <br />its May 20, 1991 meeting and includes a compromise by both parties to resolve <br />a long-standing difference in the contract interpretation regarding the <br />Authority's interest inthe City's original facilities. This settlement also <br />establishes a value of $139,676 per 100,000 GPD capacity in the City's <br />wastewater facilities as of May 1, 1991 to be used for possible future <br />capacity allocation cost calculations. Mayor McClain, while in agreement <br />with the buy-back terms, specifically stated that the City does not accept <br />the reference to the PSA's "1/3 perpetual interest" in the City's facilities <br /> <br /> <br />
