APRIL 23. 1991 <br /> <br />BEIT ORDAINED by the Council of the City of Martinsville~' Virginia. <br />in regular session assembled this twenty-third day of April, 1991, <br />that the Zoning Map of the City of Martinsville, Virginia, be--and <br />is hereby--amended to the extent that Lot 20 (Lot 26), located on <br />the northeast side of Griggs Road is hereby rezoned from R-9 <br />Residential to P-2 Professional. <br /> <br />BE IT FURTHER ORDAINED by said Council, that, an emergency <br />existing, this Ordinance shall be in force on and after April 24, <br />1991. <br /> <br />.Councilconducted a public hearing on a request by the Piedmont Shrine Club <br />for a Special Use Permit to conduct an '.'amusement enterprise" on an outlot at <br />Liberty Fair Mall from April 24-May 5, 1991. There being no persons present <br />to comment on this matter, Mayor McClain declared the public hearing closed. <br />In response to a question by Vice-Mayor Groden, Mr. Brown explained that any' <br />needed traffic control on Commonwealth Boulevard as a result of the operation <br />of the amusement enterprise would be the responsibility of the Police <br />Department and that traffic control on the Mall property would be the <br />responsibility of those operating the amusement enterprise. Upon motion, <br />duly seconded and by unanimous vote, Council approved the Special'Use Permit. <br />subject to the conditions which were attached to the permit by the Planning <br />Commission. <br /> <br />Councilconsidered adoption, on first reading, of Ordinance No..'91-2 amending <br />Subsection (1) Class 1 Misdemeanor, of Section 1-11 Classification of and <br />Penalties for Violations; Continuing Violations Generally, of Chapter 1 <br />General Provisions, of the City Code. Commonwealth's Attorney J. Randolph <br />Smith waspresentand stated that an Ordinance was adopted during 1990 which <br />made the..penalties-. for all violations of City ordinances, except Class 1 <br />misdemeanors, conform with the maximum penalties allowable=under State law. <br />The City was unable. to bring Class 1 misdemeanor penalties into-conformity <br />with State law because of the limitations of the City Charter as well as <br />Section 15.1-901 of the State Code.
