TUESDAY. AUGUST 25. 1992 <br />amending the City's Zoning Ordinance regarding transient storage of <br />hazardous waste. Rev. William Barber asked that an amendment be made <br />to the Ordinance to place restrictions on the distance which such waste <br />could be stored from a residential area· In response to a question <br />from Council, City Attorney Worthy stated that such an amendment could <br />interfere with interstate commerce, thereby possibly rendering the <br />Ordinance invalid. Councilman Williams spoke in favor of the distance <br />restriction, but said that he would support the opinion of the City <br />Attorney. Upon motion, duly seconded and by unanimous vote, Council <br />adopted the following Ordinance No. 92-15: <br /> <br />BE IT ORDAINED by the Council of the City of Martinsville, Virginia, in <br />regular session assembled, August 25, 1992, that Section VIII Special <br />Use Procedure of the City's Zoning Ordinance be amended by adding <br />Subsection 2 to Paragraph O Special Uses Permitted in the M-1 and M-2 <br />Districts Using the Special Use Procedure, and by amending Section II <br />Definitions of the City's Zoning Ordinance by adding "Hazardous Waste" <br />and "Transient Storage", as follows: <br /> <br /> Section VIII <br />Special Use Procedure <br /> <br />Special Uses Permitted in the M-1 and M-2 Districts Using the <br />Special Use Procedure. <br /> <br />All of the Special Uses found in Section VIII, Paragraph <br />G. <br /> <br />Transient storage of hazardous waste. provided that the <br />hazardous wastes are stored and contained in a manner <br />which is approved by all appropriate requlatory <br />agencies. Once waste is removed from a transient <br />storage site it may not return to that site. if it was <br />removed for the purpose of permitting its storage at the <br />site inquest,on for another period of ten days or less. <br />The petition for a special use permit shall be <br />accompanied by: <br /> <br />Plans showing the location and size of the <br />area to be used. including existing and <br />proposed buildings. and all buildings and <br />structures within five hundred (500) feet <br />adjacent thereto. and; <br /> <br />Plans showing location and extent of all <br />parking and service loading and unloading <br />areas having a minimum setback from all <br />property lines of fifty (50) feet. <br /> <br /> <br />
