TUESDAY, MAY 26, 1992 <br />Virginia Business and Education Commission. It was noted that the <br />General Assembly had established the Commission "to encourage and <br />expand business participation and involvement in public education and <br />to foster partnerships between the public and private sectors to <br />enhance public education in Southside Virginia." Several members of <br />Council stated that this item may be more properly considered in <br />connection with the FY 93-94 budget, and further, that as the State had <br />created the Commission, it should provide full funding for it as well. <br />Upon motion, duly seconded and by unanimous vote, Council decided to <br />not fund the request at this time and to ask the City Manager to <br />prepare a letter to Dr. Max Wingett, President of PHCC, and area <br />legislators explaining Council's position on this matter. <br /> <br />Upon motion, duly seconded and by unanimous vote, Council adopted, on <br />second reading, Ordinance No. 92-4 authorizing the imposition and <br />collection of a local tax on the probate of every will or grant of <br />administration in the Clerk's Office of the Circuit Court as follows: <br /> <br />WHEREAS, Section 58.1-1712 under Article 3 of Chapter 8 under Subtitle <br />I under Title 58.1 of the 1950 Code of Virginia, as amended, authorizes <br />the imposition of a tax of the probate of every will or grant of <br />administration in the Clerk's Offices of the Circuit Courts of this <br />Commonwealth; and <br /> <br />WHEREAS, Section 58.1-1718 of said Code provides that, in addition to <br />the state tax imposed by Section 58.1-1712, that .the Council of any <br />city may impose a city tax on the probate of every will or grant of <br />administration in an amount equal to one-third of the amount of the <br />state tax thereon; now, therefore, <br /> <br />BE IT ORDAINED by the Council of the City of Martinsville, Virginia, in <br />regular session assembled on May 26, 1992, that a city tax be, and it <br />hereby is, imposed on the probate of every will or grant of <br />administration in the Clerk's Office of the Circuit Court of the City <br />of Martinsville in an amount equal to one-third of the state tax on <br />such probation of a will or grant of administration, and <br /> <br />BE IT FURTHERORDAINED, pursuant to the provisions of Section 58.1-3806 <br />of said Code, that the tax imposed by this ordinance shall be collected <br />by the Clerk of the Circuit Court of the City of Martinsville who shall <br />pay the taxes so collected unto the Treasurer of the City of <br /> <br /> <br />
