TUESDAY, APRIL 28, 1992 <br /> <br />abandonment and presented a petition from twelve residents of Oak <br />Street opposing the abandonment. After much discussion, and upon <br />motion, duly seconded and by unanimous vote, Council decided to not <br />close the public hearing and to carry consideration of the item over to <br />the May 12, 1992 Council meeting so that further notification could be <br />provided to residents of the area. <br /> <br />Upon motion, duly seconded and by unanimous vote, Council adopted, on <br />second reading, the following Ordinance No. 92-3: <br /> <br />BE IT ORDAINED by the Council of the City of Martinsville, <br />Virginia, in regular session assembled April 28, 1992, that <br />it does hereby amend the City Code by adding Subsection 7 to <br />Chapter 13 Offenses--Miscellaneous, Section 13-11 Excessive, <br />Unnecessary, etc., Noise, as follows: <br /> <br />Sec. 13-11. Excessive, unnecessary, etc., noise. <br /> <br />(a) It shall be unlawful and a Class 1 <br /> misdemeanor for any person: <br /> <br />(7) <br /> <br />To emit, from any loudspeaker or sound- <br />amplification equipment located in or on any <br />vehicle, trailer, airplane, balloon, or boat, <br />any music, speech, or noise which can be <br />heard outside of such vehicle, trailerr <br />airplane, balloon, or boat by the unaided <br />human ear, between the hours of 12:00 <br />midnight and 7:00 a.m. following, in any <br />residential district of the city. <br /> <br />Council considered a request by the Sheriff for a supplemental <br />appropriation for FY 91-92. It was noted that the Sheriff was <br />requesting an additional $13,500 appropriation to cover medical <br />expenses for the prisoners. In response to questions from Council, <br />City Sheriff Maynard Gilley stated that the additional expenditures <br />were the result of an increased jail population as well as an increase <br />in illness by the prisoners. Upon motion, duly seconded and by <br />unanimous vote, Council approved the supplemental appropriation. <br /> <br /> <br />
