TUESDAY, MARCH 9, 1999 <br />were discussed in said Executive Session; and (2) only those business matters identified in the motion <br /> <br />convening the Executive Session were heard, discussed, or considered during said Session. <br /> <br />Following their return to open meeting the Martinsville Redevelopment and Housing Authority took the <br />actions below, by the following vote: <br /> <br />Adopted the following Resolution authorizing the City Attorney to proceed with <br />condemnation of property located at 206 Montgomery Street. <br /> <br />RESOLUTION <br /> <br />WHEREAS, the Martinsville Redevelopment and Housing Authority, a political subdivision organized and <br />existing under the laws of Virginia, pursuant to federal and state law previously resolved that a public necessity <br />exists to undertake a redevelopment project within the City of Martinsville, Virginia, known as the Moss-Barton <br />Redevelopment Project; and <br /> <br />WI-IEREAS, in order to accomplish the purpose of said project it is necessary for the Martinsville Redevelopment <br />and Housing Authority to acquire fee simple title to a lot or parcel of land owned by Jesse Andrew Penn, Olice M. <br />Penn, Ellie Penn Daugherty, and Lucille Penn located at 206 Montgomery Street, Martinsville, Virginia; and <br /> <br />WHEREAS, pursuant to authority previously granted, agents of the Authority have previously made a bona fide <br />but ineffectual effort to purchase said land from Jesse Andrew Penn, Olice M. Penni Ellie Penn Daugherty and <br />Lucflle Penn, but were unable to do so because of inability to agree upon the purchase price; and <br /> <br />WFIEREAS, it is necessary to bring a condemnation suit in which the question of fair and just compensation for <br />said land shall be determined, and in which such suit proceedings may also be brought pursuant to Section 25-46.8 <br />of the Code of Virginia to acquire fee simple' title to said land prior to the determination and deposit of said award <br />for just compensation; now, therefore, <br /> <br />BE IT RESOLVED by the Martinsville Redevelopment and Housing Authority at a duly called meeting held on <br />March 9, 1999, that David B. Worthy be, and he hereby is, authorized and directed to bring and conduct a <br />condemnation suit to determine fair and just compensation for said land in the name of and on behalf of <br />Martinsville Redevelopment and Housing Authority and/or its members, and, as such attorney, make oath to the <br />condemnation petition all in accord with applicable federal statutes and regulations, and with the statutes of this <br />Commonwealth in such cases made and.proVided; and <br /> <br />BE IT FURTHER RESOLVED that said attorney be, and he hereby is, authorized and directed at any. time after <br />filingthe condemnation proceeding and prior to the determination and deposit of the award of just compensation, to <br />do whatever is required by Section 25-46.8 of the Code of Virginia, including, without limitation, haVing the City <br />Treasurer pay into Court for the benefit of the owners of said land the amount of a good faith estimate o.f the value <br /> <br /> <br />
