4) All operational services will be provided by the City. <br /> <br />5) <br /> <br />The operation of the City's Landfill shall be seven days a week in <br />order to continue to accommodate the County's solid waste collection <br />schedule. <br /> <br />6) <br /> <br />The County agrees that it will assign and transfer to the City all of its <br />rights, title, and interest in all solid waste delivered to and accepted by <br />the City at its facility. <br /> <br />7) <br /> <br />The City, as owner of the facility, retains the right to reject any waste <br />brought to the facility which is not allowable or acceptable waste as <br />defined by the Solid Waste Management Regulations or which is <br />otherwise a problem or threat to the landfill operation. <br /> <br />s) <br /> <br />If, during the term of this Agreement, the City's Landfill is forced to <br />close, the City will not be responsible for transferring the County's <br />solid waste to another facility nor will the City accept any liability in <br />this regard. <br /> <br />9) <br /> <br />Upon closure of the City Landfill, the County will not be financially <br />responsible for any activities related to normal closure and post <br />closure activities prescribed by EPA/DEQ regulations.
