Enclosure #7 <br /> <br />AGREEMENT FOR THE USE OF THE <br />CITY OF MARTINSVILLE <br />SOLID WASTE DISPOSAL FACILITY <br />BY HENRY COUNTY <br /> <br /> This Agreement made and entered into on this day of , <br />1999, by and between the City of Martinsvi!le, a municipal corporation and political <br />subdivision of the Commonwealth of Virginia, party of the first part and the County <br />of Henry, a political subdivision of the Commonwealth of Virginia, party of the <br />second part. <br /> <br /> WHEREAS, the Henry County Board of Supervisors has requested the <br />continued use of the City of Martinsville's Sanitary Landfill past the current <br />contract expiration date of June 30, 1999; and <br /> <br /> WHEREAS, the City has obtained an operational variance from the Virginia <br />Department of Environmental Quality which allows the City to continue its <br />operations utilizing the existing footprint of the !andfill; and <br /> <br /> WHEREAS, the City has conservatively projected it operational program <br />using available landfill space through the year 2002; <br /> <br />NOW THEREFORE, the parties to this Agreement hereby agree as follows: <br /> <br />1) The term of this Agreement shall be for a two (2) year period, <br /> commencing on July 1, 1999, and ending on June 30, 2001. <br /> <br />2) <br /> <br />The tipping fee throughout the term of this Agreement which the <br />County agrees to pay the City shall be fixed at $30.00 per ton. <br />However, this fee may be adjusted by the City if, during the term of <br />this agreement, the City experiences an operational cost increase due <br />to changes in federal or state environmental or other laws/regulations <br />affecting the disposal of solid waste. Documentation to support any <br />requested increase shall be forwarded to the County Administrator <br />for review and comment prior to the imposition of any increase. In <br />addition, the tipping fee shah apply to all other solid waste customers, <br />contractors, businesses, and industries hauling waste that originates <br />in the County to the City Landfill, and the responsibility for the <br />payment of the tipping fee shah be the responsibility of these <br />customers independent of the County. <br /> <br />3) <br /> <br />The tipping fee will apply to all material, including sludge, except tires <br />which shah be charged at the rate of $1.00 per tire, or $100.00 per ton <br />if hauled to the facility in bulk quantities. The tire disposal rate may <br />change prior to or during the Agreement period based on contract <br />disposal costs. <br /> <br /> <br />
