TUESDAY, MAY 11, 1993 Upon motion, duly seconded and by unanimous vote, Council approved the rezoning request. In accordance with Section 2.1-344(A) of the CODE OF VIRGINIA (1950, and as amended), and upon motion, duly seconded and by unanimous vote, Council convened into Executive Session for the purpose of consultation with legal counsel, as authorized by Subsection 7. At the conclusion of this Executive Session, each member of Council certified that (1) only public business matters exempted from open meeting requirements were discussed in said Executive Session; and (2) only those business matters identified in the motion convening the Executive Sessionswere heard, discussed or considered during said Session. Upon motion, duly seconded and by unanimous vote, Council decided the City Landfill would continue to operate beyond October 9, 1993 and the City would pursue a variance from the Director of the Virginia Department of Waste Management to allow for continued operation of the Landfill beyond January 1, 1994. Upon motion, duly seconded and by unanimous vote, Council adopted the following Resolution approving a request by Beverly Enterprises, Inc. (dba/Martinsville Convalescent Home) for the Martinsville Industrial Development Authority to refund and issue new bonds in the amount of $2,280,000: A Resolution of the City Council of the City of Martinsville, Virginia, approving, among other things, the issuance of the Industrial Development Authority of the City of Martinsville, Virginia, $2,280,000 Industrial Development Revenue Refunding Bonds (Beverly Enterprises, Inc. Project) Series 1993, (the Bonds) to the extent required by Section 147 of the Internal Revenue Code of 1986, as amended and by Section 15.1-1378.1 of the Code of Virginia, 1950, as amended.
