TUESDAY, MAY 11, 1993 <br />Upon motion, duly seconded and by unanimous vote, Council approved the <br />rezoning request. <br /> <br />In accordance with Section 2.1-344(A) of the CODE OF VIRGINIA (1950, <br />and as amended), and upon motion, duly seconded and by unanimous vote, <br />Council convened into Executive Session for the purpose of consultation <br />with legal counsel, as authorized by Subsection 7. At the conclusion <br />of this Executive Session, each member of Council certified that (1) <br />only public business matters exempted from open meeting requirements <br />were discussed in said Executive Session; and (2) only those business <br />matters identified in the motion convening the Executive Sessionswere <br />heard, discussed or considered during said Session. <br /> <br />Upon motion, duly seconded and by unanimous vote, Council decided the <br />City Landfill would continue to operate beyond October 9, 1993 and the <br />City would pursue a variance from the Director of the Virginia <br />Department of Waste Management to allow for continued operation of the <br />Landfill beyond January 1, 1994. <br /> <br />Upon motion, duly seconded and by unanimous vote, Council adopted the <br />following Resolution approving a request by Beverly Enterprises, Inc. <br />(dba/Martinsville Convalescent Home) for the Martinsville Industrial <br />Development Authority to refund and issue new bonds in the amount of <br />$2,280,000: <br /> <br />A Resolution of the City Council of the City of Martinsville, Virginia, <br />approving, among other things, the issuance of the Industrial <br />Development Authority of the City of Martinsville, Virginia, $2,280,000 <br />Industrial Development Revenue Refunding Bonds (Beverly Enterprises, <br />Inc. Project) Series 1993, (the Bonds) to the extent required by <br />Section 147 of the Internal Revenue Code of 1986, as amended and by <br />Section 15.1-1378.1 of the Code of Virginia, 1950, as amended. <br /> <br />WHEREAS, the City of Martinsville, Virginia (the City) is a political <br /> <br /> <br />
