TUESDAY, JANUARY 26, 1993 <br /> <br />vote, Council approved the supplemental appropriation. Several members <br />of Council thanked Mr. Dahlquist for appearing at two Council meetings <br />to support this request. <br /> <br />Upon motion, duly seconded and by unanimous vote, Council adopted, on <br />second reading, the following Ordinance No. 93-1: <br /> <br />WHEREAS, the Virginia Board of Housing and Community <br />adopted the Virginia Statewide Fire Prevention Code, <br />hereinafter referred to as the SFPC; and <br /> <br />Development <br /> sometimes <br /> <br />WHEREAS, the said SFPC provides that it may be enforced by any local <br />government or by the State Fire Marshal in those jurisdictions in which <br />the local governments do not enforce said Code, and that any local <br />government enforcing same may assign responsibility for its enforcement <br />to a fire official of its choice and may establish such procedures or <br />requirements as may be necessary for said enforcement, and may also <br />adopt fire prevention regulations that are more restrictive or more <br />extensive in scope than the SFPC provided that such regulations are not <br />more restrictive than the Uniform State Building Code and do not affect <br />the manner of construction, or materials to be used in the erection, <br />alteration, repair, or use of the building or structure; and <br /> <br />WHEREAS, said SFPC also provides that the fees for any permit required <br />thereby shall be stipulated in the local regulations; now, therefore, <br /> <br />BE IT ORDAINED by the Council of the City of Martinsville, Virginia, in <br />regular session assembled on January 26, 1993, that Article III of <br />Chapter 9 of the Code of the City of Martinsville, Virginia, be amended <br />as follows: <br /> <br />ARTICLE III. FIRE PREVENTION CODE <br /> <br />Sec. 9-46. <br /> <br />Enforcement. <br /> <br /> That certain Fire Prevention Code known as the Virginia Statewide <br />Fire Prevention Code, duly adopted by the Virginia Board of Housing and <br />Community Development pursuant to the authority of Section 27-97 of the <br />1950 Code of Virginia, as amended, shall be enforced in the City of <br />Martinsville, Virginia, by its local government, and the responsibility <br />for said enforcement is hereby assigned to the fire official, who shall <br />be the City Fire Marshal, and who shall be empowered to exercise all <br />the enforcement authority described and provided in said SFPC. <br /> <br /> The Martinsville board of appeals is hereby designated as the <br />appeals board to hear appeals arising for the application of the <br />provisions of "The Statewide Fire Prevention Code." <br /> <br />Sec. 9-47. Permits. <br /> <br /> No permit required by the SFPC which also requires an on-premises <br />inspection by the fire official shall be issued until a fee of $25.00 <br /> <br /> <br />
