TUESDAY, AUGUST 9, 1994 <br /> <br />Martinsville, in regular session held on August 9, 1994, that said 20 <br />foot path hereinabove described and as shown on said plat be, and the <br />same hereby is, vacated, and <br /> <br />BE IT FURTHER ORDAINED that if no appeal from the adoption of this <br />ordinance is filed within 30 days from its effective date to the <br />Circuit Court of the City of Martinsville, the Clerk of Council, be, <br />and he hereby is, authorized and directed to record a certified copy of <br />this ordinance in said Clerk's Office, and thereby vest fee simple <br />title to the centerline of said path from its east side in the owner or <br />owners of Lots 41 and 42 of said subdivision, and from the west side in <br />the owner of Lot 43 of said subdivision, and, <br /> <br />BE IT FURTHER ORDAINED, that in order to start the running of the 30 <br />day appeal time, that an emergency exists, and that this ordinance <br />shall become effective on the date of its adoption, that is to say, on <br />August 9, 1994. <br /> <br />Council considered adoption of an amendment to the City's Purchasing <br />Manual in order to allow for a preference for local vendors in the case <br />of tie bids. J. Gary Via, Purchasing Agent, explained the change was <br />being proposed due to action by the 1994 General Assembly which allows <br />local governments to give preference to local vendors in the case of <br />tie bids, given that all specifications are equal. In response to a <br />question from a member of Council, Mr. Via stated that tie bids occur <br />very rarely. Upon motion, duly seconded and by unanimous vote, Council <br />approved the amendment as proposed. <br /> <br />Council considered authorizing the City Manager to execute a renewal <br />lease with Friends of the Court - Understanding Through Sharing (FOCUS) <br />for City-owned property located at 17 Moss Street. City Manager Earl <br />B. Reynolds, Jr. noted that during the FY 93-94 budget process, the <br />City denied a funding request by FOCUS. Prior to that time, FOCUS had <br />been leasing the property at 7 Moss Street for $90 per month. It was <br />agreed by Council to lease the property to FOCUS for $1.00 per year for <br />FY 93-94. Mr. Reynolds recommended that since FOCUS did not request or <br />receive any funding from the City for FY 94-95, Council authorize him <br />to execute a renewal lease for FY 94-95 for $1.00 per year.
